R.A.R.I.N. SAMPLE R&R DEPARTMENT FORMS



Amalyah Keshet, Director of the Visual Resources Department at the Israel Museum, Jerusalem, Board Member of the Museum Computer Network, and Chair of MCN's Intellectual Property SIG, has generously made available to this website the many forms used by her department. Some take the form of contracts, some letters, some faxes. The content - flexible and changeable according to negotiatied circumstances - is what is provided here.

Museums may wish to use some of these forms as models in developing their own forms. These forms should not be construed as being definitive in and of themselves. It is advised that legal counsel be consulted in their adoption or adaptation at any institution that might wish to use them under their own letterhead.

 

PERSONAL USE
Copy Request Form This form is required of anyone desiring to draw (as a copyist) in the galleries. Permission may be granted or denied.

Permission to Photograph in the Museum This form is required of anyone desiring to take photos for personal use.

 

MUSEUM USE
Commissioned Photography This is the agreement used when the museum hires a photographer to take photographs for the museum.

Commissioned Video Production This agreement is used when the museum hires a filmmaker to produce video-based material for the museum.

Non-Exclusive License Agreement This agreement is sent to an artist or copyright owner upon acquisition of a work by the museum. It gives the museum non-exclusive rights (the copyright owner may license non-exclusive rights to other parties as well).

Private Owner Permission This notification to the museum by the owner of an object on display in the museum, consents to the licensing of an image of the object by the museum. This assumes that the copyright to the object itself is in the public domain.

 

LICENSE REQUESTS - INTERNAL PROCESSING
Detailed Information Request This form is sent after an intial request has been made. It clarifies all possible details of use of the images for which rights have been requested.

Notice of Availability, Price & Prepayment Requirement This notice from the museum confirms availability of images, states the price, and notifies client that prepayment is necessary.

Schedule of Standard Print Publication Terms and Fees This is a preliminary statement of terms and fees, it is not the contract itself.

Delivery Note This accompanies each delivery of materials. It can include the license of reproduction rights, or it can cover "on spec" orders: materials from which a selection will be made. It further states the licensee's obligations with respect to the term of loan of materials and their return, conditions including artist's copyright, and serves as a receipt of delivery.

 

THIRD PARTY USE
Permission to Photograph for Professional Use This agreement sets forth the conditions, responsibilities and permission for use of photographs made by outside photographers for non-museum purposes. It requires the publisher's as well as the photographer's signature.

Electronic Publication License This license sets forth duration of use, resolution limits, anti-piracy provisions, copyright issues, fees, and other conditions for use of digitized image files in electronic publications (CD-ROMs)

License for Web Use This agreement requires detailed information from the requester and includes clauses on: duration, image storage, image manipulation restrictions, anti-piracy provisions, copyright issues, fees, and additional conditions.

Filming Location Agreement This contract sets out the fees, conditions and responsibilities of the Museum and the film crew, director, producer, and distributor.
