Loan is secured by an 82,850 sf, three-building industrial property in Pompano Beach, FL, built in 1966. The 5/26/2009 inspection rated the Property in Fair condition. YE 12/31/2008 NCF DSCR is 1.30x with 100% Occ, which has since severely declined to 56% as of 6/30/2009. First Mail Marketing (\''FMM'') occupied two units totaling 26,280 sf (31.7% NRA); their 12,000 sf space has a 12/31/2009 lease exp; their 14,280 sf space has a 1/1/2021 lease exp. According to the Primary Servicer, the Borrower indicated on 6/16/2009 that FMM abandoned their leases in Feb 2009, and the Bwr is currently in litigation with FMM. Summit Design (10,000 sf; 12.1% NRA) has a 1/1/2010 lease exp, however, Summit recently informed the Bwr that they are unable to continue their rent obligations, and was vacating on 6/30/2009. Pentair, Inc. (15,000 sf; 18.1% NRA) has a 4/30/2010 lease exp; the Bwr indicated that Pentair has not yet responded to their request to negotiate a lease extension. Bank of America has requested the Primary Servicer''s follow-up with Borrower re: status of litigation with FMM; obtain Bwr''s marketing plan and current leasing efforts; and collect/provide past due 1Q 2009 FS/RR, and a current rent roll; awaiting a response.
