Loan is secured by a 72,682 sf anchored retail shopping center in Tucson, AZ, built in 2006. The 4/17/2008 inspection rated the Property in Good condition. YTD 3/31/2009 NCF DSCR is 1.01x with 98% Occ; YE 12/31/2008 NCF DSCR was 1.32x with 100% Occ. DSCR decline at 1Q09, based on annualized figures, is attributed to decreased Exp Reimb. Bank of America has learned that the anchor tenant, Bashas\'' Inc., (54,022 sf; 74.3% NRA; $11.30 psf/yr; 4/30/2026 lease expiration), is at risk for potential store closing within the year. The Chandler, Arizona-based Bashas'' supermarket chain had already closed five stores in 2/2009, and announced plans to shutter additional locations within the next few months. subsequently, ten more stores closed on 7/21/2009. Bashas'' family of stores consists of Bashas'' Grocery, Food City, AJ''s Fine Foods, and Ike''s Farmers Markets. According to recent media coverage, the store closures are a result of increased competition among grocers in the Phoenix area and shrinking profit margins. The region experienced unusually high supermarket competition stemming from too many new store openings within the last two years; as such, the market became oversaturated. On 7/13/2009, Bashas'' Inc. filed for Chapter 11 Bankruptcy reorganization. Bashas'' senior leadership cited the recession''s impact on Arizona as the reason for filing, and the company hopes to emerge from Chap 11 at the end of 1Q 2010. Media coverage indicates that Bashas'' secured a $45 MM line of credit and is working with its lenders, creditors and attorneys to draft the company''s future operating plan. The press quoted Bashas'' President/COO as having stated, “We are not going out of business. We are not winding down our operations.” Bank of America contacted Borrower to confirm if they''ve discussed with Bashas'' the likelihood of subject store closure; awaiting a response.
