The property was inspected on 07/16/08; rated in Good condition. The Q2-2009 NCF DSCR is 1.26 with an occupancy of 100%. The loan has been placed on the watchlist due to 04/30/2009 annoucement that Chrysler Corporation (Chrysler) has filed Chapter 11 bankruptcy. Per the announcement, the company will emerge from bankruptcy within 30 days with Fiat as the probable majority owner. Chrysler will close all plants beginning 05/04/09 and they will remain closed during the bankruptcy. Chrysler is the single tenant at the subject property with a lease expiring on 03/01/2016. Chrysler operates a trucking/warehouse distribution center at the subject property. Per a late May 2009, Borrower verbally stated that to date, the lease has not been rejected. Bwr further stated that should Chrysler vacate, they have confidential prospect for the sapce. Asking rates would be slightly higher than Chrysler current rate of $11.50 Due to the recent Chapter 11 bankruptcy announcement, a servicing trigger event has occurred, and the loan is now cash managed. Bank of America will continue to monitor the loan.

The loan was transferred to Special Servicing after the DBSI master tenant filed bankruptcy in Nov-08. Lender, DBSI and the TIC investors entered into a settlement agreement regarding the so-called silo funds and DBSI paid those amounts to the TIC investors, c/o lender. The lender has approved the TIC investors\' replacement manager and agreed to restructure terms. Lender discovered that one of the bldgs is in flood zone AE. The restructure will close after borrower obtains flood insurance, expected by 8/31/09.
