4A-Occ < 80% U/W Occ. The loan is secured by a 172,304 sf retail property in Birmingham, AL built in 2001. The property was inspected on 02/12/09; rated in Good condition. Q1-2009 NCF DSCR is 1.23 with an occupancy of 72%. The decline in occupancy is a result of Linens n Things (\''LNT'') vacating prior to lease expiration as a result of LNT full liquidation plan for all stores. LNT occupied 20.31% NRA or 35,000 sf at the property with a lease expiration of 01/31/2017. As of June 2009 rent roll, there is 42,109 vacant sf at the property. Borrower stated that the LNT space is very visible within the shopping center. As of Aug 2009, there are no firm prospects for the former LNT space, however, Borrower did state the box is in a good position and is anticipated to be filled at some point. For the remaining 7,109 sf, an LOI has been signed with a prospect for 5568 sf for a 6 yr term with rent at $22/psf for years 1-3 and $23/psf for years 4-6. Asking rates are $12 PSF which is in line with market rates as per Borrower. Space will be advertised by cold calling and email blasts to brokers and retailers. Bank of America will continue to monitor the loan.
