4A - Occupancy < 80% U/W Occ. The loan is secured by a 335,420 sf retail property in Duluth, GA built in 1996.The property was inspected on 02/16/09; rated in Good condition. The Q1-2009 NCF DSCR is 1.48 with an occupancy of 70%. The decline in occ is a result of the vacating of tenant, Goody\''s (occupied 35,172 sf or 10.49% NRA with a lease expiration of 05/31/2011) and Hob-Lob, Ltd (occupied 53,000 sf or 15.80% NRA with a lease expiration of 01/31/2011) space is dark. In June 2008, Goody''s filed Chapter 11 bankruptcy protection during their restructure process. Based on the rent rolls provided for Q1-2008 and Q2-2008, Goody''s at the subject property vacated during Q2-2008. Per Borrower, Hob-Lob, Ltd. is still paying rent in accordance with the terms of the lease. As of the 12/31/08 rent roll, there is 48,172 vacant sf at the property plus the 53,000 sf dark Hob-Lob, Ltd. space. Bwr stated that they are in the LOI stage with Micro Center to lease the former are Goody''s space for a 10 year term with 2 five year renewal options at $7.00 PSF net of CAM, RET, & INS, and there is a temporary deal with Reebok to lease the former Hob-Lob, Ltd. space. Bwr further stated that the plan is to negotiate a termination fee with Hob-Lob, LTD. and terminate the lease upon securing a replacement tenant. Asking rates for the former Hob-Lob, Ltd. space are $8.00 PSF, $10.00 PSF for the former Goody''s space, and for the smaller spaces asking rates range from $16 - $22 depending on location. Per Bwr, market rates have softened in the current economic environment. Per Bwr, small shop space rents have a wide range of rents in the market due to center quality, which range from the low to mid teen''s PSF up to approximately $20.00 psf. Anchor space market rents range from approximately $7 to $11 psf. Bank of America will continue to monitor the loan.
