YE 2008 DSCR was 1.42 with occupancy of 90%. The subject loan is being monitored for delinquency. Per the primary servicer the borrower has stated they are late due to a tenants rent check that was returned. The borrower is working on getting the funds from the tenant and will be sending in a check to bring the loan current. Bank of America will continue to monitor the loan.

YE 2008 NCF DSCR is 1.48 with occupancy of 92%. Office Depot has announced that it will be closing some of their stores. The plan to close 112 stores will reduce the chain\''s base to 1,163. It plans to close 45 stores in the Central U.S., 40 in the Northeast and Canada, 19 in the West and 8 in the South. Office Depot is the largest tenant occupying 28,827 sf (16.17% NRA) with a lease expiration of 5/31/2010. Per the borrower Office Depot has renewed their lease through 2014 and does not have plans to close the subject store. Additionally, there is a Goody's at the subject which occupies 22,204 sf (12.45% NRA) with a lease expiration of 10/31/2009. Goody's has vacated the premises and has not paid rent since November. Per the borrower there are several interested parties for the Goody's space and there are discussions of dividing the space into two suites. There are currently no LOI's or firm leasing discussions. The Office Depot is still open and per the borrower will not be closing. Pro-forma analysis without Goody''s = 1.45/1.28 DSCR with occupancy at 78%. Bank of America has requested 1Q 2009 financials from the primary servicer and will continue to monitor the loan.
