The loan was transferred to special servicing on 01/21/09 as imminent payment default due to borrower\'s failure to make the 01/01/09 payment, remit the tax escrow shortfall and the approximately $800,000 in accounts payable. A hello letter was sent to the borrower on 01/28/09 and counsel was engaged on 01/27/09. Judicial foreclosure (average timeframe of 10 months, uncontested) was filed on 03/11/09. Because the complaint includes a demand for a deficiency judgment against the guarantors since full recourse was triggered as a result of fraud at origination and violation of the due-on-encumbrance provisions, the borrower is contesting the foreclosure.
