Loan transferred to special servicer 11/10/08 as a result of the Chapter 11 filing of sponsor DBSI (TIC syndicator) and its affiliates. Borrowing entity filed separate Chapter 11 filing on 01/09/09. Cases have been procedurally consolidated. The loan is paid to 11/01/08; however, a partial payment was received 3/02/09. The loan includes a $400,000 environmental groundwater remediation reserve related to environmental issues of a former dry cleaner tenant. Borrower indicates nearly $140,000 was spent on environmental cleanup during 2008 and has requested a reserve disbursement for prior monitoring and remediation. This is not being considered at present as a result of the bankruptcy. Title will not be taken until the environmental issues are understood / corrected. The updated appraisal has been received. Occupancy as of 5/05/09 is 78%. The 12/31/08 YTD operating statement reflected a NOI DSCR of .45x. Lift of stay relief order terminating automatic stay issued by Bankruptcy court 07/06/09. Legal counsel engaged 07/20/09 to proceed with receivership and foreclosure. Ground Lessor contacted 07/27/09 - process in place to cure lease agreement default and protect security. Appointment of Trustee will be filed for recordation to initiate the foreclosure process in Idaho.
