Loan transferred to special servicer 11/10/08 as a result of the Chapter 11 filing of DBSI (TIC syndicator) and its affiliates. The loan is paid to 9/01/09. The asset has been released from the bankruptcy; there is a settlement agreement releasing the reserve accounts that were being claimed as assets of the bankruptcy estate that has been executed by the TIC members DBSI and Lender. Bankruptcy issues are nearing complete resolution and the loan documents have been amended and are awaiting execution by the borrower that reflects the change in master tenant. Special Servicing is currently in discussion with the borrower to settle outstanding default interest, legal fees and late charges.
