Briefing was completed on February 14, 1994. Oral argument was held before a panel comprised of Chief Judge Breyer and Circuit Judges Stahl and Torruella on April 6, 1994. Following his nomination to the U.S. Supreme Court, Chief Judge Breyer recused himself in the case. In an order entered on July 18, 1994, the court directed that the case be reargued in the October, 1994 session. Oral argument was held for a second time on October 6, 1994, before a panel comprised of Chief Judge Torruella and Circuit Judges Boudin and Stahl. The court's decision was finally handed down on March 9, 1995.
