PETITION FOR LEAVE TO INTERVENE

Pursuant to Rule 64 of the Rules of Practice and Procedure before the Public Utilities Commission, the undersigned Carl Oppedahl, a ratepayer in the State of Colorado, petitions for leave to intervene in the above-captioned proceeding.

I have a substantial interest in the subject matter of the proceeding because in coming months I expect that I will need to be able to set up data communications links between several sites in Summit County, Colorado. The application of US West would, if granted, deny me the ability to use Local Area Data Service (LADS) lines in setting up the data communications links. In addition, a grant of this application would stifle competition in the provision of data communications services, leaving US West as a monopoly supplier of such services. Such stifling of competition would likewise deny me any meaningful consumer options in this area. I have been trying to place an order for LADS service for some weeks and, but for US West's intransingence, would probably be a LADS customer right now.

I do not presently know the nature and quantity of evidence which will be presented if intervention is granted.
