Upon payment of the agreed fees, and under the conditions laid
down herein, <publisher>
is granted license of one-time, non-exclusive, <_____>-language
world reproduction rights for use of the following images (or

1. DURATION OF AGREEMENT
License is for the above-named product only. Duration of this
agreement is for <_____> years. At the end of that time,
if the product has not been published, license renewal may be
applied for. If production is canceled, all scans must be erased,
and a signed statement to that effect sent to Photographic Services,
the <_____> Museum.
2. STORAGE OF IMAGES IN DIGITAL DATA BASE
The client is licensed to store the images in his digital database
for the duration of this agreement only. The copyright in any
digitized version or copy of these photographs made in the course
of the permitted use of the photo shall be retained by the Museum.
3. RESOLUTION LIMITS
Maximum resolution on product: 72 dpi
Maximum file size on product: 100 kb
4. IMAGE MANIPULATION
The <_____> Museum retains the right to view and approve
at the beta stage all scans, and any color corrections, cropping,
detailing, manipulations, and adjustments to its images, as well
as their placement in conjunction with other images, text, sound
and video, and the accuracy of identifying text.
5. ANTI-PIRACY PROVISIONS
All digital images will be protected by one of the following means:
1. Download, Print, Save As, Copy, Paste functions disabled.
2. Watermarking: credit line, The <_____> Museum, appearing on the image near the bottom edge, or directly alongside or under each image.
Images will be limited to no larger than half-screen size and will be embedded for viewing purposes only.
6. COPYRIGHT NOTICE
The product must include, where appropriate, notice of use of
the <_____> Museum images in the on-screen text: Collection
The <_____> Museum. Photos (c) The <____> Museum.
The product should also include, both on-screen and on packaging, a general copyright warning of the following type:
"This CD-ROM and its contents are protected under the copyright laws of <name of country>. It is a criminal offense to make for sale or hire or to distribute an infringing copy of any part of this work. Those found guilty of doing so are liable to prosecution."
6a. ARTIST'S COPYRIGHT
Use of works of art in which artist's copyright is currently valid
must be cleared by the client, and written notification of such
clearance must be submitted IN ADVANCE to the Museum.
7. LIABILITY FOR INFRINGEMENT OF COPYRIGHT
The producer accepts full liability for infringement of <_____>
Museum copyright material due to non-conformance with paragraphs
3,5, 6 and 6a above.
8. FEES
Search/service fees and fees for prints and loan of slides or
transparencies to be paid up front: <___>

9. PROVISION OF COPIES
Upon the <_____> Museum's request, one copy of the product
will be submitted to the Museum for the purpose of verifying usage
of the images. The Museum reserves the right to revoke this license
if any material terms of the agreement have not been complied
with.
10. ADDITIONAL CONDITIONS
Any text and/or narration describing the <_____> Museum,
its collections and activities, must be checked for accuracy by
the <_____> Museum.
The Museum reserves to itself all rights except those expressly licensed in this agreement.
If the proposed product is not produced, the licensed rights automatically revert to the Museum.
No re-use or re-purposing of the images will be permitted without further licensing agreement.
No sub-licensing of these images to third parties is permitted, nor assignment of this agreement to any third party. Failure to comply will result in the automatic cancellation of this agreement.
<publisher> and <distributor> will be jointly and separately responsible for all their obligations according to this agreement, and each will also guarantee the obligations of the others.
