Congress Conspires to Legitimize Spam!

WHY IS THIS PAGE PINK?

No unsolicited email of a commercial nature (email advertising a product or service, offerings to participate in a business venture, invitations to purchase any product, solicitations for donations of time, money, goods, prayers, and the like) or religious or political proseletyzing or ranting of any sort, is permitted at any of the email addresses under my control.

At present, those email addresses include (but are not limited to) the following:

	spammers_lie@pobox.com
	tbetz@panix.com
	tbetz@cloud9.net
Sending any unsolicited email of a commercial, political, survey or religious nature to the email addresses listed above (or any other email address under my control) constitutes agreement to the following terms:

  • Sending me unsolicited commercial, political, survey or religious email constitutes an act of criminal trespass upon my property (i.e., my email address) and may be prosecuted as such under any and all applicable state and local laws;
  • Sending me any email for any business, political, survey or religious purpose waives any right to privacy for the sender and for the staff and management of any of the systems employed by the sender to transmit it;
  • Sending me unsolicited commercial, political, survey or religious email grants me unlimited permission to reproduce in part or entirety such unsolicited email in any form or forum I deem appropriate, free of any charge or hindrance;
  • Sending me unsolicited commercial, political, survey or religious email may also be prosecuted under any and all other applicable state, Federal, and local laws, including those applying to junk faxes, harassment, and/or fraud.
  • For example:

    	47 USC Sec 223(b)(1)(c)
    
    	(1) Prohibitions 
    	    It shall be unlawful for any person 
    	    within the United States - (C) to use 
    	    any telephone facsimile machine, 
    	    computer, or other device to send an 
    	    unsolicited advertisement to a telephone 
                facsimile machine;
    
    	47 USC Sec 223(b)(3)
    
    	(3) Private right of action 
    	    A person or entity may, if otherwise 
    	    permitted by the laws or rules of 
    	    court of a State, bring in an 
    	    appropriate court of that State - 
    	    (A) an action based on a violation of 
    	        this subsection or the regulations 
    	        prescribed under this subsection to 
    	        enjoin such violation, 
    	    (B) an action to recover for actual 
    	        monetary loss from such a violation, 
    	        or to receive $500 in damages for 
    	        each such violation, whichever is 
    	        greater, or 
    	    (C) both such actions. If the court 
    	        finds that the defendant willfully 
    	        or knowingly violated this subsection 
    	        or the regulations prescribed under 
    	        this subsection, the court may, in 
    	        its discretion, increase the amount 
    	        of the award to an amount equal to 
    	        not more than 3 times the amount 
    	        available under subparagraph (B) of 
    	        this paragraph. 
    
    
    On the other hand, if you aren't trying to sell me anything, aren't asking me to do anything for you, or if I have specifically asked you for information of a commercial, political, survey or religious nature, and you can prove it, then by all means, email me!

    I'd love to hear from you.

    Be forewarned, though... my email address is heavily spam-filtered. If you are using one of the Internet providers notorious for being junk email sources, or if you include in your email the IP numbers or fully qualified domain names of any known junk email sources, it's probably going to bounce with an autocomplaint unless I have specifically whitelisted you first.

    Sorry, but I've just had enough of the junk emailers assaulting me.
