I, for One, Welcome Our New Inflatable Rat Overlords

Now that Joe Biden has fired corrupt National Labor Relations Board general counsel Peter Robb, it appears that Scabby the Rat is safe for now.

Robb, a former union busting lawyer, has been on a jihad against the union mascot Scabby the Rate, First Amendment be damned.

Hopefully, the new NLRB council won’t be such a corrupt unethical bastard:

The fate of Scabby the Rat is up in the air after President Joe Biden forced out National Labor Relations Board general counsel Peter Robb, who had made it one of his top priorities to deflate the union protest symbol, and tapped a new acting general counsel on Monday.

In one of his first actsafter taking office Jan. 20, Biden sent the Trump-appointed Robb and deputy NLRB general counsel Alice Stock packing. On Monday, Biden tapped NLRB Chicago regional director Peter Sung Ohrto be acting general counsel.

Legal experts say those shake-ups could mean the end of Robb’s attempt to muzzle the ratbased on a legal theorythat unions violate the National Labor Relations Act when they deploy the fanged, red-eyed rodent in so-called secondary boycotts.

And the general counsel has the authority to decide which cases can continue to proceed before the board, said Alyssa Busse, a union-side attorney at Allison Slutsky & Kennedy PC, which could mean the end of cases that seek to upend precedent protecting the inflatable pest.

“Even though the general counsel is separate from the board, the general counsel still has significant influence on which cases are brought before the board,” Busse said.

The general counsel’s office is challenging an NLRB administrative judge’s ruling that the display, which shamed Lippert “for harboring rat contractors,” may have embarrassed company officials but did not block customers or workers. Robb wanted the board to consider doing away with two Obama era decisions that gave workers the right to use banners and Scabby during secondary protests as long as they were not confrontational or disruptive.

In October, the NLRB sought public inputon whether it “should alter its standard” and limit workers’ rights to display the rat and banners during secondary protests.

Those comments, now submitted to the board, put the case even closer to a decision that could upend the current law, clarify it or leave it untouched.

But a more likely path is that the acting general counsel will drop the case against Lippert Components, according to Andrew D. Midgen, an attorney at labor-side firm Pitta LLP.

“Even though the [Lippert] case is fully briefed, the acting GC has the authority to withdraw the complaint. There are good grounds within the NLRA and Supreme Court precedent that decides prosecutorial and adjudicatory decision-making within the agency,” Midgen said. “As long as it’s a prosecutorial decision, then the final authority rests within the acting GC. The decision as to whether to pursue a complaint is a prosecutorial decision.”

Whether the board issues a decision on the Lippert case, or another case pending at the board over Scabby, Ohr could also change the guidance to NLRB regional offices on how to handle relevant cases and what legal theories they must pursue, experts said.

Robb’s office issued multiple memos in recent years ordering regional offices to pursue cases in which unions allegedly violated the NLRA by using the rat and other long-recognized symbols of labor protests that often pop up during union demonstrations.

Here’s hoping that this is the beginning of a trend.

One of the worst things that Obama did when he got into office was to knife labor in the back by abandoning the  the Employee Free Choice Act.

It was horrible policy, and worse politics.

Impeach ……… Again

Let’s be clear, inciting sedition, even if it might be protected by the 1st amendment, and I am not sure, I am an engineer, not a lawyer dammit,* but it can still be a legitimate charge for an impeachment.

So I do approve of the new impeachment charges that the House just delivered to the Senate.

If he is convicted, he loses his pension, and his secret service protection, and it would likely result in his being forbidden from holding office ever again.

I will note that impeachment is, and has always been intended to be, a political process in addition to being a quasi-judicial process, and the Democrats must jam up the Republicans as much as is humanly possible.

Make them pay for their obsequious prevarication with regard to Trump:

Nine House managers walked across the Capitol to inform the Senate that they were ready to prosecute the former president for “incitement of insurrection.” And the Justice Department opens inquiry into an “improper attempt” by officials to overturn the presidential election.

At this point, even many members of the “Q Collective” have realized that Trump screwed them, and in the still quite spaces the Republican establishment wants him gone too.

Making this establishment go to the mat for an inverted traffic cone is just desserts.

Live in Obedient Fear, Citizen

In response to the Supreme Court ruling Carpenter v. United States in 2018, whcih stated that law enforcement had to get a warrant to track people via their cell phones, elements of the US State Security Apparatus are purchasing exactly the same data from commercial suppliers without a warrant.

We need to make it illegal for US law enforcement to get private data from commercial suppliers that would otherwise require a warrant, if just because it would knock the pins out from underneath literal vampire* capitalist Peter Thiel’s business plan for Palantir.

Purchasing commercial information should not be allowed to be an excuse for using commercial vendor as a cut-out to the 4th amendment:

A military arm of the intelligence community buys commercially available databases containing location data from smartphone apps and searches it for Americans’ past movements without a warrant, according to an unclassified memo obtained by The New York Times.

Defense Intelligence Agency analysts have searched for the movements of Americans within a commercial database in five investigations over the past two and a half years, agency officials disclosed in a memo they wrote for Senator Ron Wyden, Democrat of Oregon.

The disclosure sheds light on an emerging loophole in privacy law during the digital age: In a landmark 2018 ruling known as the Carpenter decision, the Supreme Court held that the Constitution requires the government to obtain a warrant to compel phone companies to turn over location data about their customers. But the government can instead buy similar data from a broker — and does not believe it needs a warrant to do so.

“D.I.A. does not construe the Carpenter decision to require a judicial warrant endorsing purchase or use of commercially available data for intelligence purposes,” the agency memo said.

Mr. Wyden has made clear that he intends to propose legislation to add safeguards for Americans’ privacy in connection with commercially available location data. In a Senate speech this week, he denounced circumstances “in which the government, instead of getting an order, just goes out and purchases the private records of Americans from these sleazy and unregulated commercial data brokers who are simply above the law.”

It has been known that the government sometimes uses such data for law enforcement purposes on domestic soil.

The Wall Street Journal reported last year about law enforcement agencies using such data. In particular, it found, two agencies in the Department of Homeland Security — Immigration and Customs Enforcement, and Customs and Border Protection — have used the data in patrolling the border and investigating immigrants who were later arrested.

The military has also been known to sometimes use location data for intelligence purposes.

In November, Vice’s Motherboard tech blog reported that Muslim Pro, a Muslim prayer and Quran app, had sent its users’ location data to a broker called X-Mode that in turn sold it to defense contractors and the U.S. military. Muslim Pro then said it would stop sharing data with X-Mode, and Apple and Google said they would ban apps that use the company’s tracking software from phones running their mobile operating systems.

Mr. Wyden’s coming legislation on the topic appears likely to be swept into a larger surveillance debate that flared in Congress last year before it temporarily ran aground after erratic statements by President Donald J. Trump, as he stoked his grievances over the Russia investigation, threatening to veto the bill and not making clear what would satisfy him.

The the 4th amendment should never be for sale.

*I do mean this characterization of Thiel literally.  He is literally a vampire who wants to use the blood of the young to extend his lifespan.

Without Racism, the Right is Nothing

WaPo writer Phillip Bump defends Joe Biden from accusations that targeting racism is in fact an attack on the whole right wing movement in an essay titled, “Biden’s targeting of racist extremism is being portrayed as an attack on the right itself.”

The ever-racist Rand Paul has accused Biden’s of, “Calling us white supremacists, calling us racists, calling us every name in the book.”

Paul is saying that, “Biden thinks Republicans are racist liars.”

I think that Joe Biden’s entire political career shows that he is willing to work with Republicans, and he does not think that they are [all] racists liars.

This is complete bullshit.  It is clear that Biden’s efforts and  pronouncements are a NOT apart of deliberate effort to demonize and perhaps prosecute the his political opposition.

His entire career mitigates against this accusation.  Biden has always gone along to get along with the most contemptible people in politics.

However, there is a way that Rand Paul’s accusation IS accurate.

Specifically, it should be noted that the modern conservative movement, at least back to the days of William F. Buckley’s endorsements of segregation (And arguably as far back as the founding of the Republic), racism has been inseparable from the political right in the United States.

It is transparently obvious that meaningful sustained efforts to fight racism in will necessarily target the right wing.

Short version of this argument:  If Rand Paul is concerned that Joe Biden’s fighting racism is an attack on him, then Rand Paul needs to stop being a racist dirt-bag.

I Do Not Approve

The 7 year interval between leaving the service and being able to become Secretary of Defense is there for a reason, to ensure that the Department of Defense is under civilian controls.

It has only been waived twice before, for George Marshall in 1950, and James Mathis in 2017, and now Lloyd Austin has been confirmed as SecDef less than 5 years after leaving the service.

I do not approve.

This limit was put in place for a good reason, that you do not want the inmates running the asylum, but not it appears that this is likely to become a common state of affairs:

The Senate on Friday confirmed Lloyd J. Austin III as defense secretary, filling a critical national security position in President Biden’s cabinet and elevating him as the first Black Pentagon chief.

The 93-2 vote came a day after Congress granted Mr. Austin, a retired four-star Army general, a special waiver to hold the post, which is required for any defense secretary who has been out of active-duty military service for less than seven years. It reflected a bipartisan consensus on Capitol Hill that it was urgent for Mr. Biden to have his defense pick rapidly installed, a step normally taken on a new president’s first day.

That Mr. Austin is not the first black SecDef not matter.

This is corrosive of civilian control of the military.

In Case You Were Wondering Just How Toxic the BJP Is………

It appears that the veneration of Nathuram Godse, the man who assassinated Mahatma Gandhi, is now a thing in India.

I would argue that India is further down the road to Fascism and genocide that Trump ever got, and that the opposition, though careerism and incompetence, cannot seem to do anything to stop it:

Last Sunday, in a nondescript building in the India city of Gwalior, 200 miles south of Delhi, a large crowd of men gathered. Most wore bright saffron hats and scarves, a colour evoking Hindu nationalism, and many held strands of flowers as devotional offerings.

They were there to attend the inauguration of the Godse Gyan Shala, a memorial library and “knowledge centre” dedicated to Nathuram Godse, the man who shot Mahatma Gandhi. The devotional yellow and pink flowers were laid around a black and white photograph of Godse, the centrepiece of the room.

On 30 January 1948, Godse stepped out in front of Gandhi and shot him three times at point-blank range. A fervent believer in Hindu nationalism, Godse thought Gandhi had betrayed India’s Hindus by agreeing to partition, leading to the creation of Pakistan, and by championing the rights of Muslims. In 1949, Godse was hanged for Gandhi’s murder.

In the following decades, Godse was widely decried as a terrorist and traitor, the murderer of the “father of India”. Yet, in recent years, as Hindu nationalism has moved from an extremist fringe to mainstream Indian politics – the ruling Bharatiya Janata party (BJP) has a Hindu nationalist agenda at their core – Godse’s public reputation has steadily shifted from being condemned as traitor to being venerated as a misunderstood Indian patriot.

Meanwhile, Gandhi’s vision of a secular India with equal rights for all religions has been eroded and subjugated since the BJP came to power in 2014.

“Godse did the right thing by killing Gandhi,” said Devendra Pandey, 53, national secretary of Hindu Mahasabha, the Hindu nationalist organisation behind the memorial library. He was vocal in his belief that India should be declared “a country rightfully for Hindus” and that its 200 million Muslims should move to Pakistan.

“Godse considered Gandhi as his father, so to kill him must have caused him great pain but he had a very real reason,” he said. “Godse took action because Gandhi betrayed India – this library will teach the next generation how Godse was a true nationalist martyr.”

At some point there will be a reckoning in India over the country’s embrace of bigotry and its increasingly aggressive attempts to expel and subjugate Muslim Indians.

OK, This Promise was Kept

Joe Biden has shutdown the Keystone XL pipeline:

One of President Biden’s first acts upon taking office was to cancel the permit for the Keystone XL pipeline, the long-debated project to transport crude from Canada’s oil sands to the United States.

But Canadian officials, notably in Alberta, the province where the pipeline originates, are not giving up so fast.

The nearly 1,200-mile Keystone XL was intended to carry crude oil from Canada to Nebraska, where it would connect with an existing network to deliver the crude to refineries on the Gulf of Mexico.

In canceling the pipeline, Mr. Biden took some of his first steps toward reversing the legacy of the Trump administration, which revived the project after it was rejected by President Barack Obama in 2015.

Good.

Elections have consequences.

Meanwhile, in DC

Republicans in Congress are using the right-wing insurrection on January 6 as an excuse for bills targeted primarily at peaceful protesters like Black Lives Matter.

Republicans never miss an opportunity to use a crisis to rat-fuck the country, do they?

In September, Florida governor and Trump ally Ron DeSantis proposed a bill dubbed the Combating Violence, Disorder and Looting and Law Enforcement Protection Act to create new criminal penalties for offenses commonly committed during protests. He said it was needed to stop the “professional agitators bent on sowing disorder and causing mayhem in our cities” following months of largely peaceful Black Lives Matter protests.

Hours after a far-right mob stormed the Capitol at the behest of the president, Florida Republicans introduced a version of the bill. That night, DeSantis said the violence in Washington shows that lawmakers “have no time to waste to uphold public safety” and must “swiftly pass this bill.”

DeSantis isn’t alone. Within the past year, lawmakers in 24 states have introduced at least 45 bills to create new penalties or increase criminal penalties for offenses related to protesting, discourage cuts to police funding, and provide protections to people who drive their cars into protesters or shoot protesters in an alleged act of self defense. Six of those bills—one in Utah, one in Mississippi, one in West Virginia, one in Tennessee and two in South Dakota—have been signed into law.

But the bills aren’t aimed at reining in the kind of violent insurrectionists who stormed the Capitol, and federal prosecutors already have a litany of charges at their disposal to hold the perpetrators accountable. The bills seek to criminalize conduct typically associated with Black Lives Matter protests, like blocking streets or highways and camping out at state capitols. Provisions of DeSantis’s bill seek to discourage local governments from cutting police budgets, but what happened on Jan. 6 can’t be pinned on a lack of police funding or intelligence—the FBI knew extremists were planning to commit violence in Washington days before, and Capitol Police rejected offers for additional manpower from the National Guard. While some police officers were brutally attacked or took action to protect the lives of others, others shook hands with a member of the mob. One police officer even took a selfie with the insurrectionists.

This is why I oppose changes to the current laws in response to the January 6 insurrection.

The people who will be enforcing these laws, cops, prosecutors, etc.  are objectively pro-fascist and institutionally, if not necessarily personally, racist.

All that more laws get you is more opportunities for abuse.

Homophobic When It Suits Them

I am referring, of course, to the Massachusetts Democratic Party, which unleashed an orgy of gay bashing innuendo when Holyoke Mayor Alex Morse challenged Richard Neal (D-CIGNA) in the primary.

UMASS, which is very much a part of the Democratic Party establishment (There is no Democratic Party establishment) in Massachusetts has bent over backwards to avoid embarrassment, but you cannot put lipstick on a pig:

A recently released report by the University of Massachusetts at Amherst has added new evidence of the state Democratic Party’s involvement in the public attack on Alex Morse just ahead of his primary against Rep. Richard Neal. It also found that Morse, formerly an adjunct professor at the school, did not violate university policies, yet the report still delved deeply into Morse’s private dating life with other adults.

In early August, just a few weeks prior to the election against Neal, chair of the powerful House Ways and Means Committee, a number of college students made vague accusations of impropriety against Morse, the youngest and first openly gay mayor of Holyoke.

The involvement of state party officials, who coordinated with the Massachusetts College Democrats to accuse Morse of sexual impropriety, was first revealed by The Intercept and later confirmed by an internal review by the Massachusetts Democratic Party. The new report, however, includes emails and text messages indicating that party attorney Jim Roosevelt took a more active role in the dissemination of the smear than previously known. It also reveals that party leaders were more involved in walking students through media and legal strategies than they had previously admitted. In an interview with The Intercept, Roosevelt denied the allegations; Mass Dems Executive Director Veronica Martinez implied in an email that the new report exonerated party leadership.

Investigators made a detailed exploration into the psychology of the students who ultimately launched the attack on Morse, saying that a key figure in the scandal did not find his interactions online with Morse remotely problematic until other students convinced him in hindsight that they were. A second student also told investigators that he considered his interactions platonic and innocent but that they took on a different connotation when put in the context of rumors being spread by other students.

The report’s authors included trivial information they had collected. “Witness Three reports that he was later told by other students that Morse gave him a ‘look’ when he entered the [October] event (indicating romantic or sexual interest). Witness Three did not observe anything of that nature,” the report found fit to inform the public.

Matt Walsh, a member of the Massachusetts Democratic State Committee and a board member of the Bay State Stonewall Democrats, said the exoneration of Morse is welcomed, but that in his view, the manner in which the report was written lingered on salacious details and sensationalized the mayor’s private life.

“I expected an official investigative report by a state university to be an objective assessment of facts, not a tabloid-style gossip piece,” said Walsh. “I’m glad UMass cleared Morse of wrongdoing, but they could have done so without legitimizing homophobic tropes that paint gay men as ‘creepy’ for engaging in consensual relationships.”

The Intercept’s previous reporting revealed that some students had planned to entrap and expose Morse in order to do political damage to the mayor and secure themselves internships with Neal. Neal has denied any involvement in the scheme. Campaign spokesperson Peter Panos told The Intercept in an email that the latest report makes the congressman’s innocence clear.

“This report confirms what Chairman Neal has always said, that he and his staff had nothing to do with these allegations,” said Panos. “We commend the University for their thorough investigation into the facts.”

The report doesn’t conclude anything either way on Neal’s involvement, but does note that there is no evidence of it.

The report makes clear that at least some of the allegations against Morse that later went public were rumor-driven group think, as is often the case in a college setting.

Those concerns extended beyond the school’s group. Student A, a student at UMass, said a friend of hers had had sexual contact with Morse and later felt uncomfortable because of the “power dynamic.” Witness One described her to investigators as “especially adamant that the group needed to go public with what they knew.”

Student A wanted to take the statement to Twitter in July and went so far as to work with Witness One to draft a statement to post to the site, though she ultimately declined to do so.

According to The Intercept’s previous reporting, the report produced for the Mass Dems by attorney Cheryl Jacques, and the emails and text messages reproduced in the new UMass report, the leadership of the UMass College Democrats and the College Democrats of Massachusetts took their allegations against Morse to the state party. College Democrats of Massachusetts President Hayley Fleming reached out to Massachusetts Democrats Chair Gus Bickford and Executive Director Veronica Martinez for guidance as the group prepared to bar Morse from future meetings.

Evidence in the new UMass report implicates Roosevelt in the writing of a letter for the College Democrats to send out to chapters. As one student said in a text on July 29 to other members of the CDMA executive board, Roosevelt advised the students through Bickford and Martinez that “if we want to move forward on leaking it to the press, someone would contact BLANK and tell him (on the record but unattributable so that their name doesn’t get published) that the CDMA eboard voted on this and sent it to the CM.” The full message exchange is attached to the report.

It’s clear that the Neal campaign knew that people who wanted jobs with him were engaging in vicious gay baiting, and would have been impossible for Nancy Pelosi not to know this as well when she pulled out all the stops to support the corrupt Ways and Means Chairman, but I guess those big dollar campaign donations from bad people don’t grow on trees.

Would Have Been Better to Address This Early

It turns out that the FBI is conducting background checks on National Guardsmen in the Capitol for the inauguration to make sure that a right-wing terrorist is not embedded in the force.

White Nationalists and their Talibaptist Christian Dominionist brethren have been infiltrating the US State Security Apparatus, both the military (particularly the USAF) and law enforcement.

It comes as no surprise that they are concerned about a random soldier might choose the occasion to engage in assassination.

Getting these folks out of these institutions may be the most important national security issue of the next decade:

U.S. defense officials say the federal government is conducting insider-threat screening on the 25,000 National Guard troops who have begun flowing into the nation’s capital to secure the inauguration, as concerns intensify about extremism in the ranks.

The extra precaution comes after a number of pro-Trump rioters involved in storming the U.S. Capitol on Jan. 6 turned out to have military ties, raising questions about extremist sentiment within the armed forces. Dozens of people on a terrorist watch list were in Washington as the deadly riot unfolded.

A U.S. defense official, speaking on the condition of anonymity to discuss the sensitive preparations, said the Army is working with the FBI to vet all service members supporting the inauguration. The Army maintains awareness of threats but does not collect domestic intelligence itself, the official said. It was not immediately clear how extensive the FBI vetting of the military personnel would be.

As the great Walt Kelly noted, “We have met the enemy, and he is us.” 

It is going to take a very long time to fix this.

This Is the Best Thing I’ve Read This Year

It appears that there are some women out there who are using dating apps to identify and report Capitol Hill insurrectionists.

The short version is that they change their political affiliation on the dating app, this story mentions Bumble, and when the guys start to brag to them, the screen shot the shit out of them, and then call the FBI: 

Women in Washington D.C. are taking matters into their own hands to obtain information on Capitol rioters.

After noticing an uptick in MAGA supporters on dating apps, women started wondering if the profiles could be useful to police.

“There are DOZENS of men on DC dating apps right now who were clearly here for the insurrection attempt,” Alia Awadallah tweeted. “Is that info useful at all for law enforcement?”

I know a friend of a friend who changed her preference on Bumble to Conservative. She’s matching with MAGA bros and they’re bragging and sending her pics and videos of them in the Capitol. She’s sending them to the FBI.

A coupole of podcasters decided that it would be fun to put an OAN tags on their microphones, and do interviews of people who they would later mock.

Instead, they found themselves in the middle of a violent lynch mob

Vloggers Walter Masterson and J.P. Scattini went undercover at the StopTheSteal rally to make what they thought was a comedy video, but it soon turned far darker and scarier in real time.

They put an OAN marker on their microphone, donned a Trump flag, Trump hats and flag masks, and started interviewing people. It didn’t take them long to realize they were on the edge of an angry, misinformed mob. By the time that mob had broken into the Capitol, they realized this was no ordinary rally, there wasn’t anything funny about it, and they needed to get the hell out of there.

They started off doing Borat, and they finished up doing Marie Catherine Colvin.

The Good,

Gary Gensler, who surprised everyone when he was appointed by Obama as the head of the  Commodity Futures Trading Commission (CFTC) and then aggressively pushed for regulation and investigations of fraud, is Biden’s choice to head the Securities and Exchange Commission (SEC).

Gary Gensler will be named chair of the U.S. Securities and Exchange Commission (SEC) by President-elect Joe Biden, said two sources familiar with the matter, an appointment likely to prompt concern among Wall Street firms of tougher regulation.

Gensler was chair of the Commodity Futures Trading Commission (CFTC) from 2009 to 2014, and since November has led Biden’s transition planning for financial industry oversight.

His appointment as the country’s top securities regulator is expected to put an end to the four years of rule-easing that Wall Street banks, brokers, funds and public companies have enjoyed under President Donald Trump’s SEC chair Jay Clayton.

At the CFTC, Gensler implemented dramatic new swaps trading rules mandated by Congress following the 2007-2009 financial crisis, developing a reputation as a hard-nosed operator willing to stand up to powerful Wall Street interests.

A former Goldman Sachs banker and a professor at MIT Sloan School of Management, Gensler also oversaw the prosecution of big investment banks for rigging Libor, the benchmark for trillions of dollars in lending worldwide.

When he came into the CFTC, it was assumed that he would be yet another corporate stooge.

Instead he was a pleasant surprise in an administration that was largely defined by corporate stooges.

The Bad,

Samantha Power has been picked by Biden to head USAID

Power is a bloody lunatic, who is almost as prone to demand the use of military force as the late and unlamented John McCain.

The is a warmonger of the highest order, and given that USAID is frequently used as a cutout to support regime change activities by the US State Security Apparatus, this is not good.

Former UN Ambassador Samantha Power, (in)famous for her screaming duels over Syria with late Russian envoy Vitaly Churkin, was picked by Joe Biden to head the US Agency for International Development (USAID) in his administration.

Though her appointment was rumored in Washington for weeks, Biden’s transition team officially confirmed it on Wednesday. Power is best known for her “humanitarian” interventionism advocacy. As an aide at the Obama White House, she championed US intervention in Syria and Libya – where US-backed Islamist militants sought to overthrow secular governments – in the name of stopping “genocide.”

Let us not forget that the intervention that she forcefully championed in Libya has led to the return of open air slave markets, and Syria………

And The Ugly

That would be Victoria “Fuck the EU” Nuland, whose pathological hatred of the Russians is largely responsible for the Ukraine the mess it is today.  (War, Fascism, Corruption, the deification of Nazi Sympathizers, etc.), who has been picked by Biden to be the Undersecretary of State for Political Affairs

This is a remarkably bad idea, if just because she was the prime mover behind the Ukrainian coup, which closely mirrors what happened at the Capitol on January 7

Who is Victoria Nuland? Most Americans have never heard of her because the U.S. corporate media’s foreign policy coverage is a wasteland. Most Americans have no idea that President-elect Biden’s pick for Deputy Secretary of State for Political Affairs is stuck in the quicksand of 1950s U.S.-Russia Cold War politics and dreams of continued NATO expansion, an arms race on steroids and further encirclement of Russia.

Nor do they know that from 2003-2005, during the hostile U.S. military occupation of Iraq, Nuland was a foreign policy advisor to Dick Cheney, the Darth Vader of the Bush administration.

You can bet, however, that the people of Ukraine have heard of neocon Nuland. Many have even heard the leaked four-minute audio of her saying “Fuck the EU” during a 2014 phone call with the U.S. Ambassador to Ukraine, Geoffrey Pyatt.

During the infamous call on which Nuland and Pyatt plotted to replace the elected Ukrainian President Victor Yanukovych, Nuland expressed her not-so-diplomatic disgust with the European Union for grooming former heavyweight boxer and austerity champ Vitali Klitschko instead of U.S. puppet and NATO booklicker Artseniy Yatseniuk to replace Russia-friendly Yanukovych.

Despite outrage from German Chancellor Angela Markel, no one fired Nuland, but her potty mouth upstaged the more serious story: the U.S. plot to overthrow Ukraine’s elected government and America’s responsibility for a civil war that has killed at least 13,000 people and left Ukraine the poorest country in Europe.

In the process, Nuland, her husband Robert Kagan, the co-founder of The Project for a New American Century, and their neocon cronies succeeded in sending U.S.-Russian relations into a dangerous downward spiral from which they have yet to recover.

Nuland accomplished this from a relatively junior position as Assistant Secretary of State for European and Eurasian Affairs. How much more trouble could she stir up as the # 3 official at Biden’s State Department? We’ll find out soon enough, if the Senate confirms her nomination.

The neocons’ coup de grace against Obama’s better angels was Nuland’s 2014 coup in debt-ridden Ukraine, a strategic candidate for NATO membership right on Russia’s border.

The muscle for Nuland’s $5 billion coup was Oleh Tyahnybok’s neo-Nazi Svoboda Party and the shadowy new Right Sector militia. During her leaked phone call, Nuland referred to Tyahnybok as one of the “big three” opposition leaders on the outside who could help the U.S.-backed Prime Minister Yatsenyuk on the inside. This is the same Tyanhnybok who once delivered a speech applauding Ukrainians for fighting Jews and “other scum” during World War II.

After protests in Kiev’s Euromaidan square turned into battles with police in February 2014, Yanukovych and the Western-backed opposition signed an agreement brokered by France, Germany and Poland to form a national unity government and hold new elections by the end of the year.

But that was not good enough for the neo-Nazis and extreme right-wing forces the U.S. had helped to unleash. A violent mob led by the Right Sector militia marched on and invaded the parliament building, a scene no longer difficult for Americans to imagine. Yanukovych and his members of parliament fled for their lives.

Nuland’s militaristic worldview represents exactly the folly the U.S. has been pursuing since the 1990s under the influence of the neocons and “liberal interventionists,” which has resulted in a systematic underinvestment in the American people while escalating tensions with Russia, China, Iran and other countries.

Nuland is a complete horror show, and she should be kept as far as possible from the reins of power as possible.

She is a disaster waiting to happen.

Yet Another Impeachable Offense

In the sort of thing that you know woule not happen without Trump’s specific authorization, the White House liaison to the Department of Justice Requested compromising information against Trump rape accuser E Jean Carroll

This is illegal as hell:

The White House liaison to the Department of Justice (DoJ), Heidi Stirrup, sought out derogatory information late last year from a senior justice department official regarding a woman who alleges she was raped by Donald Trump, according to the person from whom Stirrup directly sought the information.

The revelation raises the prospect that allies of the US president were directly pressing the justice department to try to dig up potentially damaging information on a woman who had accused Trump of sexually attacking her.

E Jean Carroll, a journalist and advice columnist, sued Trump in November 2019, alleging he had defamed her when he denied her account of having been raped by him. Carroll alleges Trump sexually assaulted her in a dressing room in Bergdorf Goodman, a high-end Manhattan department store, in either late 1995 or early 1996.

Stirrup apparently believed the justice department had information that might aid the president’s legal defense in the suit. The attorney who Stirrup sought information from regarding Carroll said that Stirrup approached them not long after a judge had ruled the justice department could not take over Trump’s defense.

Stirrup asked if the department had uncovered any derogatory information about Carroll that they might share with her or the president’s private counsel. Stirrup also suggested that she could serve as a conduit between the department and individuals close to the president or his private legal team.

Stirrup also asked the official whether the justice department had any information that Carroll or anyone on her legal team had links with the Democratic party or partisan activists, who might have put her up to falsely accusing the president.

Just in case you are wondering, it is NOT Ok for the White house to demand that the Department of Justice do opposition research on someone who has filed a private lawsuit against the President.

The DoJ banned Stirrup from the building after this, which, considering the fact that William Barr was Trump “Fluffer in Chief” at the time, indicates just how far beyond the pale this request was.

This needs to be investigated and someone needs to face consequences for this act.

It Really Sucks to be You

It appears that in addition to being contemptible people, the purveyors of Parler, the now-shuttered right-wing Twitter, were technically incompetent.

Their tech was incompetently managed, and  a security researcher managed to download almost every post in Parler, including deleted posts and extensive metadata.

The researcher, who asked to be referred to by her Twitter handle, @donk_enby, began with the goal of archiving every post from January 6, the day of the Capitol riot; what she called a bevy of “very incriminating” evidence. According to the Atlantic Council’s Digital Forensic Research Lab, among other sources, Parler is one of a several apps used by the insurrections to coordinate their breach of the Capitol, in a plan to overturn the 2020 election results and keep Donald Trump in power.

Operating on little sleep, @donk_enby began the work of archiving all of Parler’s posts, ultimately capturing around 99.9 percent of its content. In a tweet early Sunday, @donk_enby said she was crawling some 1.1 million Parler video URLs. “These are the original, unprocessed, raw files as uploaded to Parler with all associated metadata,” she said. Included in this data tranche, now more than 56 terabytes in size, @donk_enby confirmed that the raw video files include GPS metadata pointing to exact locations of where the videos were taken.

Hoping to create a lasting public record for future researchers to sift through, @donk_enby began by archiving the posts from that day. The scope of the project quickly broadened, however, as it became increasingly clear that Parler was on borrowed time. Apple and Google announced that Parler would be removed from their app stores because it had failed to properly moderate posts that encouraged violence and crime. The final nail in the coffin came Saturday when Amazon announced it was pulling Parler’s plug.

The privacy implications are obvious, but the copious data may also serve as a fertile hunting ground for law enforcement. Federal and local authorities have arrested dozens of suspects in recent days accused of taking part in the Capitol riot, where a Capitol police officer, Brian Sicknick, was fatally wounded after being struck in the head with a fire extinguisher. 

My suggestion to @donk_enby is that if someone comes sniffing around for the archive that she made, don’t without a subpoena.  Providing the information under compulsion indemnifies you, so if someone wants to sue you for someting like “Invasion of Privacy”, you are covered.  (NOte that I am an engineer, not a lawyer, dammit.*

My second piece of advice is that turning your personal information over to an online site is a stupid thing, and doing so to a business that caters to reactionaries is even dumber.

Businesses that cater to conservatives on the basis of politics tend to be scams.  All you have to do is listen to Rush Limbaugh or Sean Hannity, and see how many of the ads are transparent bullshit like fat burning plant extracts, overpriced gold, phony ED cures, Corona Virus Cures, etc.

For them, it’s all about the Benjamins.
