{"id":175945,"date":"2020-10-17T18:45:00","date_gmt":"2020-10-17T23:45:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2020\/10\/17\/long-overdue\/"},"modified":"2020-10-17T18:45:00","modified_gmt":"2020-10-17T23:45:00","slug":"long-overdue","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2020\/10\/17\/long-overdue\/","title":{"rendered":"Long Overdue"},"content":{"rendered":"<p>I&#8217;m not a big fan of Representative Tulsi Gabbard, but her proposal to <a href=\"https:\/\/consortiumnews.com\/2020\/10\/12\/proposed-reform-to-us-espionage-act-would-create-public-interest-defense\/\">allow defendants to use a public interest defense in cases of releases of classified information<\/a> is an idea long overdue.&nbsp;<\/p>\n<p>Prosecutions under the Espionage Act frequently resemble a kangaroo court, particularly in Judge Leonie Brinkama&#8217;s court, where she has consistently made a vigorous defense by the defendant impossible.<\/p>\n<p>Still, I&#8217;m waiting for the other shoe to drop about it, because I do not trust Gabbard:<\/p>\n<blockquote><p><span style=\"color: #2b00fe;\">Legislation proposed in Congress would amend the United States Espionage Act and create a public interest defense for those prosecuted under the law. <\/p>\n<p>\u201cA defendant charged with an offense under section 793 or 798 [in the U.S. legal code] shall be permitted to testify about their purpose for engaging in the prohibited conduct,\u201d according to a draft of the bill Hawaii Representative Tulsi Gabbard introduced. <\/p>\n<p>Such a reform would make it possible for whistleblowers like Edward Snowden, <a href=\"https:\/\/shadowproof.com\/2018\/08\/21\/reality-winners-sentencing-culmination-effort-break-whistleblowers-spirit\/\">Reality Winner<\/a>, <a href=\"https:\/\/shadowproof.com\/2018\/10\/18\/fbi-whistleblower-sentenced-prison-espionage-act\/\">Terry Albury<\/a> and <a href=\"https:\/\/shadowproof.com\/2019\/05\/09\/trump-administration-charges-alleged-drone-whistleblower-with-violating-espionage-act\/\">Daniel Hale<\/a> to inform the public why they disclosed information without authorization to the press. <\/p>\n<p>The <a href=\"https:\/\/gabbard.house.gov\/news\/press-releases\/rep-tulsi-gabbard-introduces-bill-reform-espionage-act-and-strengthen\">legislation<\/a> called the Protect Brave Whistleblowers Act is supported by Pentagon Papers whistleblower Daniel Ellsberg. <\/p>\n<p>\u201cIf this long-overdue revision of the 1917 Espionage Act had been law half a century ago, I myself could have had a fair trial for releasing the Pentagon Papers in 1971: justice under law unavailable to me and to every other national security whistleblower indicted and prosecuted since then,\u201d Ellsberg declared.<\/p>\n<p>\u2026\u2026\u2026<\/p>\n<p>As noted, government employees or contractors prosecuted under the Espionage Act would be allowed an \u201caffirmative defense\u201d under the Protect Brave Whistleblowers Act that they engaged in the \u201cprohibited conduct for purpose of disclosing to the public\u201d violations of laws, rules or regulations, or to expose \u201cgross mismanagement, a gross waste of funds, an abuse of authority, or a substantial and specific danger to public health or safety.\u201d<\/p>\n<p>\u2026\u2026\u2026<\/p>\n<p>However, the Espionage Act Reform bill appears to do more to prohibit the Justice Department from prosecuting journalists.
