{"id":175965,"date":"2020-10-10T19:06:00","date_gmt":"2020-10-11T00:06:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2020\/10\/10\/inmates-running-the-asylum\/"},"modified":"2020-10-10T19:06:00","modified_gmt":"2020-10-11T00:06:00","slug":"inmates-running-the-asylum","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2020\/10\/10\/inmates-running-the-asylum\/","title":{"rendered":"Inmates Running the Asylum"},"content":{"rendered":"<p>In what might the most extreme example of Stockholm Syndrome ever, USPTO chief Andrei Iancu has <a href=\"https:\/\/www.techdirt.com\/articles\/20201008\/13402645472\/us-patent-boss-says-no-evidence-patents-holding-back-covid-treatments-days-before-pharma-firms-prove-hes-wrong.shtml\">declared that patents are in no way slowing the emergence of new Covid-19 treatments<\/a>.<\/p>\n<p>Less than a week later, major pharma manufacturers were sued for \u2026\u2026\u2026 wait for it \u2026\u2026\u2026 patent infringement:<\/p>\n<blockquote><p><span style=\"color: #2b00fe;\">A week or so ago, the head of the US Patent and Trademark Office, Andrei Iancu, who has been an extreme patent maximalist over the years, insisted that there was simply <a href=\"https:\/\/www.law360.com\/articles\/1310264\/patents-not-barrier-to-covid-19-vaccine-access-iancu-says\">no evidence that patents hold back<\/a> COVID treatments. This is a debate we&#8217;ve been having over the past few months. We&#8217;ve seen some <a href=\"https:\/\/www.techdirt.com\/articles\/20200316\/14584244111\/softbank-owned-patent-troll-using-monkey-selfie-law-firm-sues-to-block-covid-19-testing-using-theranos-patents.shtml\">aggressive<\/a> actions by patent holders, and the usual crew of patent system supporters claiming, without evidence that no one would create a vaccine without <a href=\"https:\/\/www.techdirt.com\/articles\/20200319\/16022744137\/everyones-got-pet-project-patent-maximalist-says-we-need-longer-patents-to-incentivize-coronavirus-vaccines.shtml\">much longer patent terms<\/a>. <\/p>\n<p> Iancu was questioned about how patents might hold back life-saving innovation and he brushed it off like this was a crazy question: <\/p>\n<p>\u2026\u2026\u2026<\/p>\n<p>Iancu also shot down the idea that patents might be used to limit access to a vaccine:  <\/p>\n<p>\u2026\u2026\u2026<\/p>\n<p>But just to highlight how ridiculous Iancu&#8217;s statements were, just days later, Pfizer, Regeneron, and BioNTech &#8212; all working on COVID treatments (including the antibody cocktail that President Trump took from Regeneron) &#8212; were <a href=\"https:\/\/www.fiercepharma.com\/pharma\/pfizer-biontech-regeneron-sued-for-infringement-allele-s-patent-their-covid-19-products\">all sued for patent infringement<\/a> for their COVID treatments.  <\/p>\n<p>\u2026\u2026\u2026<\/p>\n<p>And then to make an even stronger point, pharma company Moderna &#8212; which had been facing a <a href=\"https:\/\/www.law.com\/newyorklawjournal\/2020\/09\/14\/patent-issues-highlight-risks-of-modernas-covid-19-vaccine\/\">ton of questions<\/a> about how its patents might delay COVID-19 treatment &#8212; has announced that it will <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2020-10-08\/moderna-won-t-enforce-patents-on-covid-vaccines-during-pandemic\">voluntarily agree not to enforce the patents<\/a> during the pandemic. <\/p>\n<p>\u2026\u2026\u2026<\/p>\n<p> The key point: even if Iancu pretends otherwise, people actually in the space know that patents can and will get in the way of life-saving innovation, rather than acting as an important incentive. <\/p>\n<p> It&#8217;s long past the time we recognized how damaging patents are for innovation in many different industries, including pharma, and having a Patent Office boss who simply denies reality is fundamentally unhelpful and anti-innovation. <\/span><\/p><\/blockquote>\n<p>As I have noted many times, IP law is at its core public interest law.<\/p>\n<p>As it says in the US Constitution, copyright and patent are created to, &#8220;To promote the progress of science and useful arts,&#8221; not to reward maniacal rent-seeking, which is what it has become.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In what might the most extreme example of Stockholm Syndrome ever, USPTO chief Andrei Iancu has declared that patents are in no way slowing the emergence of new Covid-19 treatments.
