{"id":176247,"date":"2020-07-30T18:43:00","date_gmt":"2020-07-30T23:43:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2020\/07\/30\/pass-the-popcorn-5\/"},"modified":"2020-07-30T18:43:00","modified_gmt":"2020-07-30T23:43:00","slug":"pass-the-popcorn-5","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2020\/07\/30\/pass-the-popcorn-5\/","title":{"rendered":"Pass the Popcorn"},"content":{"rendered":"<div style=\"border: 1px solid black; float: right; margin: 0px 10px; padding: 5px; text-align: center; width: 210px;\"><a href=\"https:\/\/i.imgur.com\/yxAUQ6B.gif\"><img decoding=\"async\" border=\"0\" bordercolor=\"white\" src=\"https:\/\/i.imgur.com\/yxAUQ6B.gif\" width=\"200\" \/><\/a><br \/><i>Pass the Popcorn<\/i><\/div>\n<p>When DC Appellate Court ruled that District Judge Emmett Sullivan had no power to investigate possible corruption in the dismissal of charges, and multiple guilty pleas, against Michael Flynn, I kind of figured that, the two judges who wrote this opinion, a Trump and a Bush appointee, had gotten away with a nakedly partisan, and nakedly corrupt, decision. <\/p>\n<p>It appears that the rest of the DC Court of Appeals was not amused, so <a href=\"https:\/\/talkingpointsmemo.com\/news\/flynn-judge-en-banc-hearing\">there will be an <i>en banc<\/i> hearing to review the decision<\/a>.<\/p>\n<p><i>En banc<\/i> means that the whole court, as opposed to the normal 3 judge panel, will be reviewing the case.<\/p>\n<p>It appears that the will be narrowly drawn, specifically covering whether Flynn, or for that matter the DoJ has the right to prevent a finding of fact, as opposed to a review of Sullivan&#8217;s ruling: <\/p>\n<blockquote><p><span style=\"color: blue;\">A federal appeals court in Washington will take a second look at a judge\u2019s effort to scrutinize the <a href=\"https:\/\/www.washingtonpost.com\/local\/legal-issues\/justice-dept-moves-to-void-michael-flynns-conviction-in-muellers-russia-probe\/2020\/05\/07\/9bd7885e-679d-11ea-b313-df458622c2cc_story.html?itid=lk_inline_manual_1&amp;itid=lk_inline_manual_1\">Justice Department\u2019s decision to drop its case against President Trump\u2019s former national security adviser<\/a> Michael Flynn.<\/p>\n<p>The full U.S. Court of Appeals for the D.C. Circuit agreed Thursday to revisit <a href=\"https:\/\/wapo.st\/3dQ9pES\">U.S. District Judge Emmet G. Sullivan\u2019s<\/a> plan to examine the politically charged matter, reviving the unusual case testing the limits of the judiciary\u2019s power to check the executive branch.<\/p>\n<p>The court\u2019s <a href=\"https:\/\/ecf.cadc.uscourts.gov\/n\/beam\/servlet\/TransportRoom\">brief order set oral arguments for Aug.\u200911<\/a>. The decision to rehear the case before a full complement of judges wipes out the June ruling from a three-judge panel that ordered Sullivan to immediately dismiss the case and said Sullivan was wrong to appoint a <a href=\"https:\/\/www.washingtonpost.com\/national-security\/court-asks-retired-judge-to-fight-justice-dept-effort-to-drop-michael-flynn-case-and-examine-if-ex-trump-adviser-committed-perjury\/2020\/05\/13\/8c0deb0a-9567-11ea-82b4-c8db161ff6e5_story.html?itid=lk_inline_manual_4&amp;itid=lk_inline_manual_4\">retired federal judge to argue against the government\u2019s move <\/a>to undo Flynn\u2019s guilty plea.<\/p>\n<p>In May, Sullivan refused to go along with the government\u2019s request to end the criminal case against Flynn, who twice pleaded guilty to lying to federal agents about his contacts with Russia\u2019s ambassador in Washington before Trump took office in 2017.<\/p>\n<p>Instead, Sullivan asked retired federal judge John Gleeson to argue against the Justice Department\u2019s request. That prompted Flynn\u2019s attorneys to take the rare step of asking the appeals court to intervene midstream, and they accused Sullivan of bias.<\/p>\n<p>\u2026\u2026\u2026<\/p>\n<p>The order from the court Thursday suggests that the judges are seeking a narrowly focused argument on the question of whether Flynn should have waited to appeal until after Sullivan rendered a decision.
