{"id":176724,"date":"2020-04-04T18:15:00","date_gmt":"2020-04-04T23:15:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2020\/04\/04\/today-in-boneheaded-rent-seeking\/"},"modified":"2020-04-04T18:15:00","modified_gmt":"2020-04-04T23:15:00","slug":"today-in-boneheaded-rent-seeking","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2020\/04\/04\/today-in-boneheaded-rent-seeking\/","title":{"rendered":"Today in Boneheaded Rent Seeking"},"content":{"rendered":"<p>The EU Court of Justice has ruled that <a href=\"https:\/\/www.techdirt.com\/articles\/20200402\/11030844224\/eu-says-that-no-rental-car-companies-dont-need-to-pay-license-to-rent-cars-with-radios-that-might-play-music.shtml\">rental car companies do not have to pay a license fee for the public performance of music when they rent a car<\/a>, even though every car made today has a radio, and the drivers could theoretically play music on the radio.<\/p>\n<p>These sort of outrageous claims are the rule, not the exception, because there are no penalties for attempting to promulgate this bullsh%$:<\/p>\n<blockquote><p><span style=\"color: blue;\">Performance Rights Organizations (PROs), sometimes known as &#8220;Collection Societies,&#8221; have a long history of demanding licensing for just about every damn thing. That&#8217;s why there was just some confusion about whether or not those with musical talents would even <a href=\"https:\/\/www.techdirt.com\/articles\/20200326\/16172544181\/permission-culture-gone-mad-worries-about-proper-license-balcony-singing-lead-collection-society-to-say-okay-you-can-sing.shtml\">be allowed to perform<\/a> from their balconies while in COVID-19 lockdown. And if you thought that it was crazy that anyone would even worry about things like that, it&#8217;s because you haven&#8217;t spent years following the crazy demands made by PROs, including demanding a license for a woman in a grocery store <a href=\"https:\/\/www.techdirt.com\/articles\/20091021\/1134566619.shtml\">singing while stocking the shelves<\/a>, a public performance license for <a href=\"https:\/\/www.techdirt.com\/articles\/20090327\/1113014276.shtml\">having the radio on<\/a> in a horse stable (for the horses), or claiming that <a href=\"https:\/\/www.techdirt.com\/articles\/20090620\/1836345299.shtml\">your ringtone<\/a> needs a separate &#8220;public performance&#8221; license, or saying that hotels that have radios in their rooms <a href=\"https:\/\/www.techdirt.com\/articles\/20100319\/1105388633.shtml\">should pay<\/a> a public performance license. <\/p>\n<p> Five years ago, we wrote about another such crazy demand &#8212; a PRO in Sweden demanding that <a href=\"https:\/\/www.techdirt.com\/articles\/20150101\/10473729575\/moronic-swedish-collections-group-argues-that-car-stereo-rental-vehicle-is-public-performance.shtml\">rental car companies pay a performance license<\/a> because their cars had radios, and since &#8220;the public&#8221; could rent their cards and listen to the radio, that constituted &#8220;a communication to the public&#8221; that required a separate license. The case has bounced around the courts, and finally up to the Court of Justice for the EU which has now, finally, <a href=\"http:\/\/ipkitten.blogspot.com\/2020\/04\/breaking-cjeu-rules-that-hiring-out-of.html\">ruled that merely renting cars does not constitute &#8220;communication to the public.&#8221;<\/a><\/span><\/p><\/blockquote>\n<p>A reevaluation, and a roll-back of implicit and explicit subsidies related to IP needs to happen sooner, rather than later.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The EU Court of Justice has ruled that rental car companies do not have to pay a license fee for the public performance of music when they rent a car, even though every car made today has a radio, and the drivers could theoretically play music on the radio.
