{"id":177014,"date":"2020-01-21T21:20:00","date_gmt":"2020-01-22T02:20:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2020\/01\/21\/uber-continues-to-evade-regulations\/"},"modified":"2020-01-21T21:20:00","modified_gmt":"2020-01-22T02:20:00","slug":"uber-continues-to-evade-regulations","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2020\/01\/21\/uber-continues-to-evade-regulations\/","title":{"rendered":"Uber Continues to Evade Regulations"},"content":{"rendered":"<div>In yet another attempt to evade regulations requiring that it treat its employees as \u2026\u2026\u2026 well \u2026\u2026\u2026 employees, it is introducing a feature <a href=\"https:\/\/www.wsj.com\/articles\/uber-is-testing-a-feature-that-lets-some-california-drivers-set-fares-11579600801\">allowing divers to bid on rides<\/a>.<\/div>\n<p>Obviously, Uber thinks that this has two advantages:<\/p>\n<ul>\n<li>It makes it easier for them to argue that the their employees are not employees.<\/li>\n<li>It will structured to encourage a race to the bottom.<\/li>\n<\/ul>\n<p>I don&#8217;t think that this will work for 2 reasons:<\/p>\n<ul>\n<li>The courts are not morons, and will likely see through it.<\/li>\n<li>As been shown with <a href=\"https:\/\/40yrs.blogspot.com\/2019\/05\/the-gig-economy-strikes-back.html\">drivers gaming surge pricing<\/a>, drivers will fight back.<\/li>\n<\/ul>\n<p>Also, it&#8217;s pretty clear that even though Travis Kalanick has left the company, the company has still not left Travic Kalanick:<\/p>\n<blockquote><p><span style=\"color: blue;\"><a href=\"https:\/\/quotes.wsj.com\/UBER\">Uber Technologies<\/a> Inc. is testing a new feature that allows some drivers in California to set their fares, the latest in a series of <a href=\"https:\/\/www.wsj.com\/articles\/uber-retools-california-fares-in-response-to-gig-economy-law-11578527202?mod=article_inline\">moves to give them more autonomy<\/a> in response to the state\u2019s new <a href=\"https:\/\/www.wsj.com\/articles\/california-enacts-law-to-classify-some-gig-workers-as-employees-11568831719?mod=article_inline\">gig-economy law<\/a>. <\/p>\n<p>Starting Tuesday morning, drivers who ferry passengers from airports in Santa Barbara, Palm Springs and Sacramento can charge up to five times the fare Uber sets on a ride, according to a person involved in developing the feature. Uber confirmed in an emailed statement that it is doing an \u201cinitial test\u201d that \u201cwould give drivers more control over the rates they charge riders.\u201d <\/p>\n<p>\u2026\u2026\u2026<\/p>\n<p>The fare test and other recent changes are part of Uber\u2019s effort to strengthen its case that its drivers operate with some degree of independence. Earlier this month, Uber capped its commissions on rides across California. Last month, it allowed drivers in the state to see where riders were going, letting them choose the trips they wanted to take. Previously, drivers agreed to trips without knowing the destination. <\/p>\n<p>Uber\u2019s latest changes will set up a bidding system that lets drivers increase fares in 10% increments, up to a maximum of five times Uber\u2019s set price, the person involved in developing the feature said. That price includes base fare, time spent and distance covered by a driver. There is no limit on how often drivers can raise prices. Once a rider pings the Uber app at the locations in the pilot program, Uber will match the rider with the driver who has set the lowest price, the person said. Drivers who have set higher fares are gradually dispatched as more riders request rides. <\/p>\n<p>\u2026\u2026\u2026 <\/p>\n<p>Starting next week, Uber plans to let drivers also set fares lower than Uber\u2019s price. In addition to choosing a higher multiple, drivers will be able to charge as little as one-tenth Uber\u2019s set price, decreasing fares 10% at a time.
