{"id":177254,"date":"2019-11-10T20:15:00","date_gmt":"2019-11-11T01:15:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2019\/11\/10\/least-surprising-news-of-the-day-3\/"},"modified":"2019-11-10T20:15:00","modified_gmt":"2019-11-11T01:15:00","slug":"least-surprising-news-of-the-day-3","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2019\/11\/10\/least-surprising-news-of-the-day-3\/","title":{"rendered":"Least Surprising News of the Day"},"content":{"rendered":"<p>There is now an investigation of the consultant McKinsey &amp; Company over what appears to be <a href=\"https:\/\/www.nytimes.com\/2019\/11\/08\/business\/mckinsey-criminal-investigation-bankruptcy.html\">egregious self-dealing in its bankruptcy consulting<\/a>:<\/p>\n<blockquote><p><span style=\"color: blue;\">McKinsey &amp; Company, the elite consulting firm that advises many of the world\u2019s largest and most powerful institutions, is facing a federal criminal investigation of its conduct advising bankrupt companies, according to five people familiar with the matter.<\/p>\n<p>Prosecutors and other Justice Department officials in New York and Washington are trying to determine if McKinsey used its influence over insolvent companies in violation of the rules of Chapter 11 bankruptcy \u2014 where billions of dollars can change hands \u2014 by quietly steering valuable assets to itself or favoring its own clients over other creditors.<\/p>\n<p>\u2026\u2026\u2026<\/p>\n<p>In the past two weeks, investigators have conducted interviews about McKinsey\u2019s actions in the bankruptcies of at least two companies, Alpha Natural Resources, a coal producer, and SunEdison, an alternative energy company, said one of the people, who was questioned by F.B.I. agents.<\/p>\n<p>The judges overseeing both those cases have already suggested that questions over McKinsey\u2019s conduct could best be resolved by the Justice Department \u2014 either with civil actions or criminal charges.<\/p>\n<p>In addition to the previously unreported criminal investigation, an investigation by the Office of the United States Trustee, a division of the Justice Department that polices the conduct of companies in the bankruptcy system, is underway.<\/p>\n<p>The office, which can seek civil penalties and make criminal referrals to prosecutors, has told judges in at least three other bankruptcy cases that it was examining McKinsey\u2019s practices.
