{"id":177255,"date":"2019-11-10T20:07:00","date_gmt":"2019-11-11T01:07:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2019\/11\/10\/before-you-give-do-your-homework\/"},"modified":"2019-11-10T20:07:00","modified_gmt":"2019-11-11T01:07:00","slug":"before-you-give-do-your-homework","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2019\/11\/10\/before-you-give-do-your-homework\/","title":{"rendered":"Before You Give, Do Your Homework"},"content":{"rendered":"<p>Among the other potential impeachable offenses that are not being investigated at the moment, are the Trump foundation&#8217;s rampant self dealing and corruption.<\/p>\n<p>The foundation is being liquidated, and paying a $2,000,000.00 fine.<\/p>\n<p>This raises a bigger point though, that <a href=\"https:\/\/www.vox.com\/future-perfect\/2019\/11\/8\/20954089\/trump-foundation-lawsuit-attorney-general\">there is little in the way of oversight or accountability for so called charitable foundations<\/a>:<\/p>\n<blockquote><p><span style=\"color: blue;\">The New York State attorney general\u2019s case against the Trump Foundation \u2014 Donald Trump\u2019s nonprofit that a <a href=\"https:\/\/www.vox.com\/2018\/12\/18\/18146487\/trump-foundation-charity-ny-attorney-general-lawsuit\">court shut down earlier this year<\/a> \u2014 has concluded. The Trumps have agreed to pay a $2 million fine, the <a href=\"https:\/\/ag.ny.gov\/press-release\/2019\/ag-james-secures-court-order-against-donald-j-trump-trump-children-and-trump\">attorney general\u2019s office said in a press release<\/a> on Thursday. <\/p>\n<p>The deal follows years of incredible, careful reporting by a number of reporters but most of all the <a href=\"https:\/\/www.washingtonpost.com\/politics\/trump-boasts-of-his-philanthropy-but-his-giving-falls-short-of-his-words\/2016\/10\/29\/b3c03106-9ac7-11e6-a0ed-ab0774c1eaa5_story.html?utm_term=.5111f2ea4dda\">Washington Post\u2019s David Fahrenthold<\/a>. As Fahrenthold discovered, the Trump Foundation often operated as a slush fund for the Trump family and Trump\u2019s businesses. It bought Trump an autographed <a href=\"https:\/\/www.washingtonpost.com\/sports\/2018\/12\/19\/trump-will-have-give-up-his-signed-tim-tebow-helmet-part-settlement\/?utm_term=.a6bfe9505423\">Tim Tebow helmet<\/a>, a <a href=\"https:\/\/www.washingtonpost.com\/politics\/a-clue-to-the-whereabouts-of-the-6-foot-tall-portrait-of-donald-trump\/2016\/09\/14\/ae65db82-7a8f-11e6-ac8e-cf8e0dd91dc7_story.html?utm_term=.7bba5c91f9b5\">portrait of himself<\/a>, and <a href=\"https:\/\/www.washingtonpost.com\/politics\/trump-used-258000-from-his-charity-to-settle-legal-problems\/2016\/09\/20\/adc88f9c-7d11-11e6-ac8e-cf8e0dd91dc7_story.html?utm_term=.452b8c5e2e0e\">money for various lawsuit settlements<\/a>. Less entertainingly but perhaps more importantly, he also <a href=\"https:\/\/www.thegazette.com\/subject\/news\/nation-and-world\/iowa-fundraiser-veterans-des-moines-veteran-trump-foundation-dissolves-president-20181218\">used a foundation fundraiser<\/a>, which was nationally televised a few days before the Iowa caucuses, to promote his presidential bid in 2016. <\/p>\n<p>Now, per the deal with the New York attorney general\u2019s office: <\/span><\/p>\n<blockquote><p><span style=\"color: blue;\">The $1.78 million in assets currently being held by the Trump Foundation, along with the $2 million in damages to be paid by Mr. Trump, will be disbursed equally to eight charities: Army Emergency Relief, the Children\u2019s Aid Society, Citymeals-on-Wheels, Give an Hour, Martha\u2019s Table, United Negro College Fund, United Way of National Capital Area, and the U.S. Holocaust Memorial Museum. The charities \u2014 which were required as part of the resolution to be entities that did not have any relationship with Mr. Trump or entities he controlled \u2014 were approved by the Office of the Attorney General and the court. <\/span><\/p><\/blockquote>\n<p><span style=\"color: blue;\">It\u2019s a fitting punishment: forcing a fake foundation that funneled money to bogus causes to actually use its money to benefit real charities. \u201cMy office will continue to fight for accountability because no one is above the law \u2014 not a businessman, not a candidate for office, and not even the president of the United States,\u201d Attorney General Letitia James concluded in her statement. <\/p>\n<p>It\u2019s a nice sentiment, but it\u2019s not true: Plenty of foundations are and remain above the law. The investigation into the Trump Foundation was unusual. There are <a href=\"http:\/\/data.foundationcenter.org\/#\/foundations\/all\/nationwide\/total\/list\/2015\">some 86,000 foundations in the United States<\/a>, with total assets of around $890 billion, and the vast majority of them never face this kind of scrutiny.<\/p>\n<p>\u2026\u2026\u2026<\/p>\n<p>The Trump case is egregious, but it didn\u2019t merely happen because Trump is seemingly prone to playing fast and loose with tax law. It happened because there are tens of thousands of foundations in the US, and they operate with little or no regulatory oversight \u2014 from state attorneys general, from the IRS, from anyone.<\/span><\/p><\/blockquote>\n<p>This really is an area that needs a sh%$-load more oversight and requirements.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Among the other potential impeachable offenses that are not being investigated at the moment, are the Trump foundation&#8217;s rampant self dealing and corruption.
