{"id":177318,"date":"2019-10-22T18:29:00","date_gmt":"2019-10-22T23:29:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2019\/10\/22\/the-worlds-smallest-violin-playing-just-for-you\/"},"modified":"2019-10-22T18:29:00","modified_gmt":"2019-10-22T23:29:00","slug":"the-worlds-smallest-violin-playing-just-for-you","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2019\/10\/22\/the-worlds-smallest-violin-playing-just-for-you\/","title":{"rendered":"The World&#8217;s Smallest Violin Playing Just for You"},"content":{"rendered":"<p>The court ruling on the FCC&#8217;s repeal of net neutrality was a mixed bag.<\/p>\n<p>On one hand, it approved the appeal, but on the other hand it noted that because the FCC&#8217;s repeal was predicated on reclassifying ISPs as an Information service, the FCC lacked the authority to preempt state regulation, which means that the net neutrality regulations passed in California and a dozen other states will go into effect,<\/p>\n<p>So <a href=\"https:\/\/arstechnica.com\/tech-policy\/2019\/10\/ajit-pai-bemoans-state-broadband-laws-but-his-actions-helped-create-them\/\">Ajit Pai has a major case of butt-hurt<\/a>, and I am amused:<\/p>\n<blockquote><p><span style=\"color: blue;\">Federal Communications Commission Chairman Ajit Pai may have belatedly concluded that federal regulation of broadband would be better for businesses than letting all 50 US states regulate Internet access. <\/p>\n<p>Speaking at the WSJ Tech Live conference yesterday, Pai said that &#8220;a uniform, well-established set of regulations&#8221; is preferable to states regulating broadband individually. &#8220;[Pai] said allowing states and local governments to pass their own laws regulating Internet services, which inherently cross state lines, creates market uncertainty,&#8221; <a href=\"https:\/\/www.cnet.com\/news\/fcc-chairman-ajit-pai-argues-a-patchwork-of-state-regs-is-bad-for-business\/\">according to CNET<\/a>.<\/p>\n<p>\u2026\u2026\u2026<\/p>\n<p>But Pai&#8217;s FCC overstepped its authority when it issued that blanket order to preempt any and all current and future state regulation of net neutrality, a panel of judges at the US Court of Appeals for the District of Columbia Circuit <a href=\"https:\/\/arstechnica.com\/tech-policy\/2019\/10\/why-ajit-pais-unhinged-net-neutrality-repeal-was-upheld-by-judges\/\">ruled this month<\/a>. The judges&#8217; reasoning was simple: Pai&#8217;s FCC lost the power to stop all state laws when it abandoned its own regulatory authority.<\/p>\n<p>&#8220;[I]n any area where the Commission lacks the authority to regulate, it equally lacks the power to preempt state law,&#8221; the <a href=\"https:\/\/www.cadc.uscourts.gov\/internet\/opinions.nsf\/FA43C305E2B9A35485258486004F6D0F\/$file\/18-1051-1808766.pdf\">judges&#8217; ruling said<\/a>.<\/span><\/p><\/blockquote>\n<p>The only thing that would make this better would be to see Pai frog marched out of the FCC offices in handcuffs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The court ruling on the FCC&#8217;s repeal of net neutrality was a mixed bag.
