{"id":177480,"date":"2019-09-09T18:11:00","date_gmt":"2019-09-09T23:11:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2019\/09\/09\/remember-that-ratf-judge-in-boston\/"},"modified":"2019-09-09T18:11:00","modified_gmt":"2019-09-09T23:11:00","slug":"remember-that-ratf-judge-in-boston","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2019\/09\/09\/remember-that-ratf-judge-in-boston\/","title":{"rendered":"Remember That Ratf%$# Judge in Boston?"},"content":{"rendered":"<p>You know, the one who <a href=\"https:\/\/40yrs.blogspot.com\/2019\/09\/the-ghost-of-judge-julius-hoffman.html\">refused to accept the prosecutors decision not to prosecute and threw a defense attorney in jail for quoting precedent<\/a>?<\/p>\n<p>Well the Supreme Judicial Court, Massachusetts&#8217; highest court, <a href=\"https:\/\/www.wbur.org\/news\/2019\/09\/09\/states-highest-court-sides-with-suffolk-da-rollins-in-straight-pride-battle-with-judge\">took all of about 25 minutes to overturn him<\/a>:<\/p>\n<blockquote><p><span style=\"color: blue;\">A Supreme Judicial Court justice sided with Suffolk County District Attorney Rachael Rollins on Monday, vacating the decision of a lower court judge to arraign a counter-protester of the so-called &#8220;Straight Pride&#8221; parade earlier this month.<\/p>\n<p>Justice Frank Gaziano <a href=\"https:\/\/www.documentcloud.org\/documents\/6391513-RoderickWebberJudgmentSJ-2019-0366.html\">wrote<\/a> that Boston Municipal Court Judge Richard Sinnott had &#8220;no authority&#8221; to reject a prosecutor&#8217;s entry of &#8220;nolle prosequi&#8221; \u2014 a decision not to prosecute the case \u2014 when arraigning defendant Roderick Webber.<\/p>\n<p>Sinnott also rejected several motions to dismiss cases against counter-protesters arrested at the Aug. 31 parade and rally.<\/p>\n<p>Rollins argued last week that Sinnott overstepped his constitutional authority in refusing her request to drop charges against some counter-protesters charged with minor infractions, like disorderly conduct. In his decision, Gaziano agreed.<\/p>\n<p>&#8220;The prosecutor&#8217;s sole authority to determine which cases to prosecute, and when not to pursue a prosecution, has been affirmed repeatedly by this court since the beginning of the nineteenth century,&#8221; Gaziano wrote.<\/p>\n<p>In total, judges <a href=\"https:\/\/www.wbur.org\/news\/2019\/09\/05\/the-arraignments-of-the-protesters-of-the-straight-pride-parade-by-the-numbers\">rejected motions to dismiss<\/a> in seven related cases; Rollins said her office will now re-review those cases in light of the decision.&nbsp;<\/span><\/p><\/blockquote>\n<p>In addition to dropping charges, as&nbsp; DA Rollins originally intended, I think that she should file a complaint with the judicial review board, because this guy is completely nuts.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>You know, the one who refused to accept the prosecutors decision not to prosecute and threw a defense attorney in jail for quoting precedent?
