{"id":178136,"date":"2019-02-25T19:43:00","date_gmt":"2019-02-26T00:43:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2019\/02\/25\/2-words-diego-garcia\/"},"modified":"2019-02-25T19:43:00","modified_gmt":"2019-02-26T00:43:00","slug":"2-words-diego-garcia","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2019\/02\/25\/2-words-diego-garcia\/","title":{"rendered":"2 Words: Diego Garcia"},"content":{"rendered":"<div>The International Court of Justice has ruled that <a href=\"https:\/\/www.theguardian.com\/world\/2019\/feb\/25\/un-court-rejects-uk-claim-to-sovereignty-over-chagos-islands\">UK&#8217;s continued administration of the Chagos Islands is illegal<\/a>.<\/div>\n<p>Normally, this would be thought less serious than, for example, the ruling against China&#8217;s claims to the South China sea, except that one of the islands is the US mega-base at Diego Garcia.<\/p>\n<p>The British government expelled all every resident of the island to accommodate the US military, so this could get ugly.<\/p>\n<p>If the British blink, I would expect the Pentagon to continue squatting on the island:<\/p>\n<blockquote><p><span style=\"color: blue;\">The UK has been ordered to hand back the <a href=\"https:\/\/www.theguardian.com\/world\/chagos-islands\">Chagos Islands<\/a> to Mauritius \u201cas rapidly as possible\u201d after the United Nations\u2019 highest court ruled that continued British occupation of the remote Indian Ocean archipelago is illegal. <\/p>\n<p>Although the majority decision by the international court of justice in The Hague is only advisory, the unambiguous clarity of the judges\u2019 pronouncement is a humiliating blow to Britain\u2019s prestige on the world stage. <\/p>\n<p>The case was referred to the court, which hears legal submissions over international boundary disputes, after <a href=\"https:\/\/www.theguardian.com\/world\/2017\/jun\/22\/un-vote-backing-chagos-islands-a-blow-for-uk\">an overwhelming vote in 2017 in the U<\/a><a href=\"https:\/\/www.theguardian.com\/world\/2017\/jun\/22\/un-vote-backing-chagos-islands-a-blow-for-uk\">N assembly<\/a> in the face of fierce opposition from a largely isolated UK. <\/p>\n<p>Delivering judgment, the president of the ICJ, Abdulqawi Ahmed Yusuf, said the detachment of the Chagos archipelago in 1965 from <a href=\"https:\/\/www.theguardian.com\/world\/mauritius\">Mauritius<\/a> had not been based on a \u201cfree and genuine expression of the people concerned\u201d. <\/p>\n<p>\u201cThis continued administration constitutes a wrongful act,\u201d he added. \u201cThe UK has an obligation to bring to an end its administration of the Chagos archipelago as rapidly as possible and that all member states must co-operate with the <a href=\"https:\/\/www.theguardian.com\/world\/unitednations\">United Nations<\/a> to complete the decolonization of Mauritius.\u201d<\/p>\n<p>\u2026\u2026\u2026<\/p>\n<p>The judgment represents a significant defeat for the UK on virtually every point it contested in the hearing last September. <\/p>\n<p>By a majority of 13 to one, the court found that the decolonisation of Mauritius had not been lawfully completed and that it must be completed \u201cas rapidly as possible\u201d.
