{"id":178936,"date":"2018-07-15T18:27:00","date_gmt":"2018-07-15T23:27:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2018\/07\/15\/burn-motherfer-burn-2\/"},"modified":"2018-07-15T18:27:00","modified_gmt":"2018-07-15T23:27:00","slug":"burn-motherfer-burn-2","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2018\/07\/15\/burn-motherfer-burn-2\/","title":{"rendered":"Burn Motherf%$#er, Burn"},"content":{"rendered":"<p>I was waiting for someone to <a href=\"https:\/\/www.theregister.co.uk\/2018\/07\/09\/apple_cfaa_battery\/\">sue Apple for hacking their iPhones when they crippled older phones with OS updates<\/a>:<\/p>\n<blockquote><p><span style=\"color: blue;\">The saga of class-action lawsuits looming over Apple&#8217;s iOS battery management took a new turn last week \u2013 as the Cupertino giant was accused of violating American hacking laws. <\/p>\n<p>A <a href=\"https:\/\/regmedia.co.uk\/2018\/07\/09\/rodriguezvapplecomplaint.pdf\">complaint<\/a> [PDF] filed in the US federal district court of northern California lists a violation of the Computer Fraud and Abuse Act among the charges filed against Cook and Co. <\/p>\n<p>The lawsuit, submitted on behalf of everyone in America who bought an iPhone or iPad that had been subject <a href=\"https:\/\/www.theregister.co.uk\/2017\/12\/20\/apple_iphone_slowdown\/\">to performance throttling<\/a> on devices that suffered from diminished battery capacity, accuses Apple of illegally tampering with devices, amongst other things. <\/p>\n<p>The suit argues that the iOS update slowed down a device in order to preserve battery life. In doing so Apple intentionally &#8220;damaged&#8221; its hardware without user knowledge or permission, violation of the CFAA, the plaintiffs \u2013 Alex Rodriguez, of Alaska, and scores of pals \u2013 claim. <\/p>\n<p>&#8220;Apple violated [the CFAA] by knowingly causing the transmission of iOS software Updates to Plaintiff and class members\u2019 devices to access, collect, and transmit information to devices, which are protected computers as defined in [the CFAA] because they are used in interstate commerce and\/or communication,&#8221; the complaint reasons. <\/p>\n<p>&#8220;By transmitting information to class members\u2019 devices, Apple intentionally caused damage without authorization to class members\u2019 devices by impairing the ability of those devices to operate as warranted, represented, and advertised.&#8221;<\/span><\/p><\/blockquote>\n<p>I really hope that Apple gets hung out to dry on this one.<\/p>\n<p>Apple&#8217;s view of iPhones seem to be that, notwithstanding the money that people pay for the devices, it is Apple, Inc. that owns them.<\/p>\n<p>They need to be disabused of this concept.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>I was waiting for someone to sue Apple for hacking their iPhones when they crippled older phones with OS updates: The saga of class-action lawsuits looming over Apple&#8217;s iOS battery management took a new turn last week \u2013 as the Cupertino giant was accused of violating American hacking laws.
