{"id":179126,"date":"2018-05-08T20:11:00","date_gmt":"2018-05-09T01:11:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2018\/05\/08\/i-dont-often-express-admiration-for-the-indian-justice-system-but\/"},"modified":"2018-05-08T20:11:00","modified_gmt":"2018-05-09T01:11:00","slug":"i-dont-often-express-admiration-for-the-indian-justice-system-but","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2018\/05\/08\/i-dont-often-express-admiration-for-the-indian-justice-system-but\/","title":{"rendered":"I Don&#8217;t Often Express Admiration for the Indian Justice System, But\u2026\u2026\u2026"},"content":{"rendered":"<p>The recent ruling by the Indian Supreme Court saying that <a href=\"https:\/\/www.ecowatch.com\/monsanto-india-cotton-patent-2566752905.html\">seeds cannot be patented<\/a> is good for the Indian people, and not just because it is bad for Monsanto:<\/p>\n<blockquote><p><span style=\"color: blue;\">In an another legal blow to <a href=\"https:\/\/www.ecowatch.com\/tag\/monsanto\">Monsanto<\/a>, India&#8217;s Supreme Court on Monday refused to stay the <a href=\"https:\/\/www.ecowatch.com\/monsanto-india-cotton-gmo-2559650068.html\">Delhi High Court&#8217;s ruling<\/a> that the seed giant cannot claim patents for Bollgard and Bollgard II, its <a href=\"https:\/\/www.ecowatch.com\/gmo-genetically-modified-organism\/\">genetically modified<\/a> cotton seeds, in the country. <\/p>\n<p> Monsanto&#8217;s chief technology officer Robert Fraley, who <a href=\"https:\/\/in.reuters.com\/article\/monsanto-ceo\/monsanto-ceo-grant-to-make-way-for-bayers-condon-post-takeover-idINKBN1I81BM\">just announced<\/a> that he and other top executives are stepping down from the company after <a href=\"https:\/\/www.ecowatch.com\/tag\/bayer\">Bayer AG<\/a>&#8216;s multi-billion dollar <a href=\"https:\/\/www.ecowatch.com\/bayer-monsanto-merger-2550813842.html\">takeover<\/a> closes, lamented the news. <\/p>\n<p>\u2026\u2026\u2026<\/p>\n<p> Monsanto first introduced its GM-technology in India in 1995. Today, more than 90 percent of the country&#8217;s cotton crop is genetically modified. These crops have been inserted with a pest-resistant toxin called Bacillus thuringiensis, or Bt. <\/p>\n<p> Citing India&#8217;s Patents Act of 1970, the Delhi High Court ruled last month that plant varieties and seeds cannot be patented, thereby rejecting Monsanto&#8217;s attempt to block its Indian licensee, Nuziveedu Seeds Ltd., from selling the seeds. <\/p>\n<p> Because of the ruling, Monsanto&#8217;s claims against Nuziveedu for unpaid royalties have been waived, as its patents are now invalid under Indian law.
