{"id":180550,"date":"2017-03-17T19:54:00","date_gmt":"2017-03-18T00:54:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2017\/03\/17\/the-oxford-comma-bitches-it-just-works\/"},"modified":"2017-03-17T19:54:00","modified_gmt":"2017-03-18T00:54:00","slug":"the-oxford-comma-bitches-it-just-works","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2017\/03\/17\/the-oxford-comma-bitches-it-just-works\/","title":{"rendered":"The Oxford Comma, Bitches, It Just Works"},"content":{"rendered":"<div style=\"border: 1px solid black; float: right; margin: 0px 10px; padding: 5px; text-align: center; width: 360px;\">\n<blockquote data-lang=\"en\">\n<div dir=\"ltr\" lang=\"en\">on the one hand I love the <a href=\"https:\/\/twitter.com\/hashtag\/oxfordcomma?src=hash\">#oxfordcomma<\/a>, on the other hand these sentences truly are SO GOOD <a href=\"https:\/\/t.co\/Gst0OSY0Wo\">pic.twitter.com\/Gst0OSY0Wo<\/a><\/div>\n<p>\u2014 Jules (@scuttling) <a href=\"https:\/\/twitter.com\/scuttling\/status\/838773095376777217\">March 6, 2017<\/a><\/p><\/blockquote>\n<p><\/div>\n<p>There is a dispute in linguistic circles as to whether or not you should the Oxford comma, which is the comma used by some before the,&#8221;And,&#8221; of the last item of a list.<\/p>\n<p>If you use the Oxford comma, you write, &#8220;I love my parents, Lady Gaga, and Humpty Dumpty&#8221; and if you eschew this convention, \u201cI love my parents, Lady Gaga and Humpty Dumpty.&#8221;<\/p>\n<p>To my mind, the latter form strongly states that your parents are Lady Gaga and Humpty Dumpty, so I am, and likely always will be, a strong supporter of the Oxford (aka serial) comma.<\/p>\n<p>Well, it appears that a judge in Maine agrees with me, <a href=\"https:\/\/www.theguardian.com\/books\/2017\/mar\/16\/oxford-comma-helps-drivers-win-dispute-about-overtime-pay\">ruling that an employer is liable for overtime pay for their truckers because of a missing comma<\/a>:<\/p>\n<blockquote><p><span style=\"color: blue;\">Never let it be said that punctuation doesn\u2019t matter.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span> <span style=\"color: blue;\">In Maine, the much-disputed Oxford comma has helped a group of dairy drivers in a dispute with a company about overtime pay.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span> <span style=\"color: blue;\">The Oxford comma is used before the words \u201cand\u201d or \u201cor\u201d in a list of three or more things. Also known as the serial comma, its aficionados say it clarifies sentences in which things are listed. <\/span><br \/><span style=\"color: blue;\"><br \/><\/span> <span style=\"color: blue;\">\u2026\u2026\u2026<\/span><br \/><span style=\"color: blue;\"><br \/><\/span> <span style=\"color: blue;\">In a judgment that will delight Oxford comma enthusiasts everywhere, a US court of appeals sided with delivery drivers for Oakhurst Dairy because the lack of a comma made part of Maine\u2019s overtime laws too ambiguous.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span> <span style=\"color: blue;\">The state\u2019s law says the following activities do not count for overtime pay:<\/span><\/p>\n<blockquote><p><span style=\"color: blue;\">The canning, processing, preserving, freezing, drying, marketing, storing, packing for shipment or distribution of:<\/span><br \/><span style=\"color: blue;\"><br \/><\/span> <span style=\"color: blue;\">(1) Agricultural produce;<\/span><br \/><span style=\"color: blue;\">(2) Meat and fish products; and<\/span><br \/><span style=\"color: blue;\">(3) Perishable foods.<\/span><\/p><\/blockquote>\n<p><span style=\"color: blue;\">The drivers argued, due to a lack of a comma between \u201cpacking for shipment\u201d and \u201cor distribution\u201d, the law refers to the single activity of \u201cpacking\u201d, not to \u201cpacking\u201d and \u201cdistribution\u201d as two separate activities. As the drivers distribute \u2013 but do not pack \u2013 the goods, this would make them eligible for overtime pay.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span> <span style=\"color: blue;\">Previously, a district court had ruled in the dairy company\u2019s favour, who argued that the legislation \u201cunambiguously\u201d identified the two as separate activities exempt from overtime pay. But the appeals judge sided with the drivers.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span> <span style=\"color: blue;\">Circuit judge David J. Barron wrote:<\/span><\/p>\n<blockquote><p><span style=\"color: blue;\">We conclude that the exemption\u2019s scope is actually not so clear in this regard.
