{"id":180670,"date":"2017-02-10T18:46:00","date_gmt":"2017-02-10T23:46:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2017\/02\/10\/trump-gets-a-bull-durham-lesson\/"},"modified":"2017-02-10T18:46:00","modified_gmt":"2017-02-10T23:46:00","slug":"trump-gets-a-bull-durham-lesson","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2017\/02\/10\/trump-gets-a-bull-durham-lesson\/","title":{"rendered":"Trump Gets a Bull Durham Lesson"},"content":{"rendered":"<p>The lesson in the movie <a href=\"http:\/\/www.imdb.com\/title\/tt0094812\/\"><i>Bull Durham<\/i><\/a> is <b><span style=\"font-size: 100%; font-variant: small-caps;\">Never Call the Umpire a C%$#sucker<\/span><\/b>.<\/p>\n<p>When Trump <a href=\"http:\/\/www.politico.com\/story\/2017\/02\/trump-blame-james-robart-234666\">disparaged (I would argue threatened) Federal Judge James Robart<\/a> after he issued an injunction against his attempted Muslim ban, it was clear that no one in the Judiciary would be happy with this.<\/p>\n<p>The 9<sup>th<\/sup> Circuit of Appeals <a href=\"https:\/\/www.nytimes.com\/2017\/02\/09\/us\/politics\/appeals-court-trump-travel-ban.html\">ruled against rescinding the injunction<\/a>, and what is significant is that they did so in a <i>per curiam<\/i> opinion.&nbsp; (Note that the crack reporters at the <i>Times<\/i> somehow missed this.)<\/p>\n<p>A <i>per curiam<\/i> opinion is unanimous, but it is also unsigned, and except in <b>extremely<\/b> rare cases (Corrupt Supreme Court Justices covering their asses in <i>Bush v. Gore<\/i>), it means something very specific.<\/p>\n<p>To quote <i>Scotusblog<\/i>, &#8220;<a href=\"http:\/\/www.scotusblog.com\/2012\/10\/scholarship-highlight-the-supreme-courts-misuse-of-per-curiam-opinions\/\">Traditionally, the <i>per curiam<\/i> opinion was used to signal that a case was uncontroversial, obvious, and did not require a substantial opinion.<\/a>&#8220;<\/p>\n<p>In other words, it&#8217;s a way to say, &#8220;Your Kung Fu is weak, and you are stinking up the place.&#8221;<\/p>\n<p>I think that the appellate court would have ruled in much the same way, and probably unanimously, had Trump not called out Judge Robart, but I think that it did so as a <i>per curiam<\/i> ruling was a message to the Trump as to what constitutes appropriate behavior with regard to the judiciary. <\/p>\n<p>The only question is whether Trump will learn from this.&nbsp; (I&#8217;m guessing that he won&#8217;t)<\/p>\n<p>The standard disclaimer applies here, I am an engineer, not a lawyer, dammit.<sup>*<\/sup><\/p>\n<p><sup>*<\/sup><span style=\"font-size: xx-small;\">I <b><span style=\"font-size: 100%; font-variant: small-caps;\">love<\/span><\/b> it when I get to go all Dr. McCoy!<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The lesson in the movie Bull Durham is Never Call the Umpire a C%$#sucker.
