{"id":181362,"date":"2016-07-20T18:13:00","date_gmt":"2016-07-20T23:13:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2016\/07\/20\/i-did-not-expect-this-from-this-circuit\/"},"modified":"2016-07-20T18:13:00","modified_gmt":"2016-07-20T23:13:00","slug":"i-did-not-expect-this-from-this-circuit","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2016\/07\/20\/i-did-not-expect-this-from-this-circuit\/","title":{"rendered":"I Did Not Expect This from This Circuit"},"content":{"rendered":"<p>The full court of appeals for the 5<sup>th<\/sup> circuit <a href=\"https:\/\/www.washingtonpost.com\/politics\/courts_law\/appeals-ourt-says-texas-voter-id-law-has-discriminatory-effect\/2016\/07\/20\/781bf340-4cef-11e6-aa14-e0c1087f7583_story.html\">just suspended most of Texas&#8217; voter suppression law<\/a>:<\/p>\n<blockquote><p><span style=\"color: blue;\">A federal appeals court ruled Wednesday that Texas\u2019s strict voter-ID law discriminates against minority voters, and it ordered a lower court to come up with a fix for the law in time for the November elections.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span> <span style=\"color: blue;\">The full U.S. Court of Appeals for the 5th Circuit, one of the most conservative in the country, declined to strike down the law completely but said provisions must be made to allow those who lack the specific ID the law requires to be able to cast a vote.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span> <span style=\"color: blue;\">Nine of the 15 appellate judges who heard the case generally upheld a district court\u2019s finding that 600,000 people, disproportionately minorities, lack the specific kind of identification required \u2014 a driver\u2019s license, military ID, passport or weapons permit, among them \u2014 and that it would be difficult for many to secure it.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span> <span style=\"color: blue;\">African American, Hispanic and poor voters were most likely to be affected, the court found.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span> <span style=\"color: blue;\">\u2026\u2026\u2026<\/span><br \/><span style=\"color: blue;\"><br \/><\/span> <span style=\"color: blue;\">\u201cIt would be untenable to permit a law with a discriminatory effect to remain in operation\u201d for the coming election, wrote U.S. Circuit Judge Catharina Haynes for the majority, made of up five judges nominated by Democratic presidents and four nominated by Republicans.<\/span><\/p><\/blockquote>\n<p>This is good news and responsible Jurisprudence.<\/p>\n<p>You don&#8217;t generally get that from the 5<sup>th<\/sup> circuit, which can give the late Antonin Scalia a run for his money on bile inspired craziness.<\/p>\n<p>Truth be told, the dissent took it to a level that would have made &#8220;Fat Tony&#8221; feel inadequate:<\/p>\n<blockquote><p><span style=\"color: blue;\">\u201cBy keeping this latter claim alive, the majority fans the flames of perniciously irresponsible racial name-calling,\u201d wrote Judge Edith J. Jones.
