{"id":181580,"date":"2016-05-13T20:09:00","date_gmt":"2016-05-14T01:09:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2016\/05\/13\/thanks-liz\/"},"modified":"2016-05-13T20:09:00","modified_gmt":"2016-05-14T01:09:00","slug":"thanks-liz","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2016\/05\/13\/thanks-liz\/","title":{"rendered":"Thanks, Liz"},"content":{"rendered":"<p>The CFPB just <a href=\"http:\/\/www.nytimes.com\/2016\/05\/05\/business\/dealbook\/consumer-agency-moves-to-assert-bank-customers-right-to-sue.html\">moved to end arbitration on consumer loans and credit cards<\/a>:<\/p>\n<blockquote><p><span style=\"color: blue;\">Richard Cordray, director of the Consumer Financial Protection Bureau, pointed out what a major change his agency was poised to bring about. \u201cMany banks and financial companies avoid accountability by putting arbitration clauses in their contracts that block groups of their customers from suing them,\u201d he said in a statement.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\">The rule would apply only to the consumer financial companies that the agency regulates. It would not apply to arbitration clauses tucked into contracts for cellphone service, car rentals, nursing homes or employment.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\">\u201cIt is a good start,\u201d said Berle M. Schiller, a federal judge in Philadelphia who has been critical of arbitration clauses that dismantle class actions and tip the scales in favor of companies. \u201cClass actions are the only way that companies can be brought to heel.\u201d<\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\">The agency\u2019s proposed rule would be the first significant check on arbitration since a pair of Supreme Court decisions in 2011 and 2013 blessed its widespread use.
