{"id":182558,"date":"2015-08-11T19:50:00","date_gmt":"2015-08-12T00:50:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2015\/08\/11\/live-in-obedient-fear-citizen-43\/"},"modified":"2015-08-11T19:50:00","modified_gmt":"2015-08-12T00:50:00","slug":"live-in-obedient-fear-citizen-43","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2015\/08\/11\/live-in-obedient-fear-citizen-43\/","title":{"rendered":"Live in Obedient Fear, Citizen!"},"content":{"rendered":"<p>It turns out that the DHS no fly list is <a href=\"http:\/\/www.theguardian.com\/us-news\/2015\/aug\/10\/us-no-fly-list-predictive-assessments\">basically based on hunches with a pseudo-scientific gloss<\/a>:<\/p>\n<blockquote><p><span style=\"color: blue;\">The Obama administration\u2019s no-fly lists and broader watchlisting system is based on predicting crimes rather than relying on records of demonstrated offenses, the government has been forced to admit in court.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\">In a little-noticed filing before an Oregon federal judge, the US Justice Department and the FBI conceded that stopping US and other citizens from travelling on airplanes is a matter of \u201cpredictive assessments about potential threats\u201d, the government asserted in May.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\">\u201cBy its very nature, identifying individuals who \u2018may be a threat to civil aviation or national security\u2019 is a predictive judgment intended to prevent future acts of terrorism in an uncertain context,\u201d Justice Department officials Benjamin C Mizer and Anthony J Coppolino told the court on 28 May.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\">\u201cJudgments concerning such potential threats to aviation and national security call upon the unique prerogatives of the Executive in assessing such threats.\u201d<\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\">It is believed to be the government\u2019s most direct acknowledgement to date that people are not allowed to fly because of what the government believes they might do and not what they have already done.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\">\u2026\u2026\u2026<\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\">On Friday, the ACLU asked Judge Anna Brown to conduct her own review of the error rate in the government\u2019s predictions modeling \u2013 a process the ACLU likens to the \u201cpre-crime\u201d of Philip K Dick\u2019s science fiction.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\">\u201cI believe this is the first case in which a court is being asked to review the basis for the government\u2019s predictive model for blacklisting people who have never even been charged, let alone convicted, of a violent crime,\u201d said ACLU attorney Hina Shamsi. <\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\">In March, as a result of the lawsuit, the Department of Homeland Security began informing people of their inclusion on a flight blacklist and permitting them to file a \u201credress inquiry\u201d. The resulting non-adversarial process has the government perform \u201ccareful consideration\u201d of its reasons for blacklisting, with the Transportation Security Agency director as final arbiter. The ACLU considers the new process insufficient.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\">But the Obama administration is seeking to block the release of further information about how the predictions are made, for the same reason it opposes providing greater information for challenging watchlist inclusion: damage to national security.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\">\u2026\u2026\u2026<\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\">In April 2014, five people, all of whom are Muslim, claimed that they were suddenly forbidden from flying after <a href=\"http:\/\/www.theguardian.com\/world\/2014\/apr\/23\/no-fly-list-fbi-coerce-muslims\">declining FBI pressure to become informants<\/a> or in order to place pressure upon them to do so. <a href=\"http:\/\/www.theguardian.com\/world\/2014\/jul\/21\/government-agents-directly-involved-us-terror-plots-report\">Informants<\/a>, along with <a href=\"http:\/\/www.huffingtonpost.com\/2015\/07\/09\/isis-twitter-fbi-islamic-state_n_7763992.html\">social media postings<\/a>, have become a driving factor in the FBI\u2019s uptick in arrests of people suspected of ties to al-Qaida and the Islamic State.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\">In July 2014, the Intercept <a href=\"https:\/\/www.blogger.com\/null\" http:=\"\" jul=\"\" us-terrorism-watchlist-work-no-fly-list=\"\" world=\"\" www.theguardian.com=\"\">published an internal watchlisting guidance<\/a>  indicating that nominations to government watchlists were growing, with  few rejections.
