{"id":182598,"date":"2015-07-29T19:07:00","date_gmt":"2015-07-30T00:07:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2015\/07\/29\/finally-a-white-prosecutor-indicts-a-cop-for-murder-under-the-color-of-law\/"},"modified":"2015-07-29T19:07:00","modified_gmt":"2015-07-30T00:07:00","slug":"finally-a-white-prosecutor-indicts-a-cop-for-murder-under-the-color-of-law","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2015\/07\/29\/finally-a-white-prosecutor-indicts-a-cop-for-murder-under-the-color-of-law\/","title":{"rendered":"Finally, a White Prosecutor Indicts a Cop for Murder under the Color  of Law"},"content":{"rendered":"<div style=\"border: 1px solid black; float: right; margin: 0px 10px; padding: 5px; text-align: center; width: 360px;\"><iframe loading=\"lazy\" allowfullscreen=\"\" frameborder=\"0\" height=\"198\" src=\"https:\/\/embed.theguardian.com\/embed\/video\/us-news\/video\/2015\/jul\/29\/prosecutor-releases-body-camera-footage-cincinnati-police-video\" width=\"352\"><\/iframe><br \/><i>Warning: This is a video of a police officer shooting a man in the head without provocation<\/i><\/div>\n<p>University of Cincinnati police officer Ray Tensing <a href=\"http:\/\/www.theguardian.com\/us-news\/2015\/jul\/29\/cincinnati-police-shooting-samuel-dubose\">has been indicted for felony murder<\/a>:<\/p>\n<blockquote><p><span style=\"color: blue;\">A white police officer who gunned down an unarmed black man in Cincinnati, <a href=\"http:\/\/www.theguardian.com\/us-news\/ohio\">Ohio<\/a>, has been indicted for murder by a grand jury, as the county prosecutor described the shooting as the \u201cmost asinine act\u201d he had ever seen committed by a police officer. <\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\"><a href=\"http:\/\/theguardian.com\/thecounted\/list#samuel-dubose-631\">Samuel DuBose<\/a>, 43, was killed on 19 July by a single shot to the head fired by University of Cincinnati police officer Ray Tensing during a routine traffic stop, in which DuBose was pulled over for not having a front license plate. <\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\">Tensing had maintained he was \u201cdragged\u201d by Dubose\u2019s vehicle after the two entered into a physical altercation and was forced to shoot, but Hamilton County prosecutor Joseph Deters said body-camera evidence completely contradicted this account. <\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\">In a frank assessment of the officer\u2019s conduct, Deters said Tensing had \u201cpurposely killed\u201d DuBose and that he \u201cshould never have been a police officer\u201d.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\">\u2026\u2026\u2026<\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\">Deters, who was visibly angered at points during the press conference, continued: \u201cHe [Tensing] wasn\u2019t dealing with someone who was wanted for murder, OK? He was dealing with someone who didn\u2019t have a front license plate. This is, in the vernacular, a pretty chicken-crap stop, all right? And \u2013 I could use harsher words. <\/span><br \/><span style=\"color: blue;\"><br \/><\/span><span style=\"color: blue;\">\u201cI\u2019ve been doing this for 30 years,\u201d he added. \u201cThis is the most asinine act I\u2019ve ever seen a police officer make, totally unwarranted.\u201d Deters also said the death reflected poorly on the university police department and had advised Cincinnati police chief Jeffrey Blackwell that the force be disbanded and replaced with a new city police precinct on campus.<\/span><\/p><\/blockquote>\n<p>If the university police department, it would be a good thing, because it&#8217;s not just this guy, <a href=\"http:\/\/www.theguardian.com\/us-news\/2015\/jul\/30\/samuel-dubose-video-police-killing-cincinnati\">two of his fellow officers obstructed justice to protect him<\/a>:<\/p>\n<blockquote><p><span style=\"color: blue;\">Police officers in Cincinnati appear to have corroborated a false account of the <a href=\"http:\/\/www.theguardian.com\/us-news\/2015\/jul\/29\/cincinnati-police-shooting-samuel-dubose\">fatal shooting of Samuel DuBose<\/a> in the immediate aftermath of the incident, a detailed analysis of body-camera video released on Wednesday shows.<\/p>\n<p>\u2026\u2026\u2026<\/p>\n<p>A Guardian analysis of the nearly 28 minutes worth of Tensing\u2019s body-camera footage released by the prosecutor\u2019s office also shows the aftermath of the shooting and reveals that on three occasions, two other police officers repeat Tensing\u2019s account that he was dragged by DuBose, and one of these officers claims to have witnessed it occurring.<\/p>\n<p>Tensing repeats, multiple times throughout the footage, the claim that he was dragged by DuBose\u2019s vehicle. But at five minutes and 44 seconds into the video, he states: \u201cI think I\u2019m OK. He was just dragging me.\u201d<\/p>\n<p>To which a second officer, who stands out of the frame, replies: \u201cYeah, I saw that.\u201d<\/p>\n<p>Tensing continues: \u201cI thought I was going to get run over.
