{"id":184241,"date":"2012-06-21T20:31:00","date_gmt":"2012-06-22T01:31:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2012\/06\/21\/scotus-slaps-down-fcc\/"},"modified":"2012-06-21T20:31:00","modified_gmt":"2012-06-22T01:31:00","slug":"scotus-slaps-down-fcc","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2012\/06\/21\/scotus-slaps-down-fcc\/","title":{"rendered":"Scotus Slaps Down FCC"},"content":{"rendered":"<div style=\"border: 1px solid black; float: right; margin: 0px 10px; padding: 5px; text-align: center; width: 360px;\"><object width=\"350\" height=\"197\"><param name=\"movie\" value=\"http:\/\/www.youtube.com\/v\/PrD6k8PDr1o?version=3&amp;hl=en_US\"><\/param><param name=\"allowFullScreen\" value=\"true\"><\/param><param name=\"allowscriptaccess\" value=\"always\"><\/param><embed src=\"http:\/\/www.youtube.com\/v\/PrD6k8PDr1o?version=3&amp;hl=en_US\" type=\"application\/x-shockwave-flash\" width=\"350\" height=\"197\" allowscriptaccess=\"always\" allowfullscreen=\"true\"><\/embed><\/object><br \/><i>Roll George Carlin!<\/i><\/div>\n<p>I agree with the outcome of the ruling, but <a href=\"http:\/\/nbcpolitics.msnbc.msn.com\/_news\/2012\/06\/21\/12338561-high-court-rules-against-fcc-in-clash-over-profanity-nudity-on-tv\">it&#8217;s too limited for my taste<\/a>:<\/p>\n<blockquote style=\"color: blue;\"><p>The Supreme Court ruled Thursday that the Federal Communications Commission failed to give two television networks, FOX and ABC, advance notice of standards before punishing them for broadcasts in which outbursts of expletives and brief nudity were aired.<\/p>\n<p>\u201cThe Commission failed to give Fox or ABC fair notice prior to the broadcasts in question that fleeting expletives and momentary nudity could be found actionably indecent,\u201d said Justice Anthony Kennedy, writing for the unanimous court.<\/p>\n<p>The ruling does not affect the FCC\u2019s policy banning indecency in TV broadcasting. <\/p>\n<p>The court said that it did need not to address the First Amendment implications of the FCC\u2019s indecency policy nor did it need to reconsider its prior indecency ruling in a 1978 decision regarding prolonged recitation of vulgar words.<\/p><\/blockquote>\n<p>The 1978 decision was bad, and vague, and they didn&#8217;t clear it up.<\/p>\n<p>They took a very narrow ruling, and invalidated the fines because the FCC was arbitrary and capricious, and did not rule on the basic underlying issue.  Ruth Bader Ginsberg felt the same way, and <a href=\"http:\/\/nbcpolitics.msnbc.msn.com\/_news\/2012\/06\/21\/12338561-high-court-rules-against-fcc-in-clash-over-profanity-nudity-on-tv\">noted so in her concurring opinion<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Roll George Carlin!
