{"id":184769,"date":"2012-01-24T23:26:00","date_gmt":"2012-01-25T04:26:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2012\/01\/24\/obama-goes-for-accelerated-review-of-healthcare-reform\/"},"modified":"2012-01-24T23:26:00","modified_gmt":"2012-01-25T04:26:00","slug":"obama-goes-for-accelerated-review-of-healthcare-reform","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2012\/01\/24\/obama-goes-for-accelerated-review-of-healthcare-reform\/","title":{"rendered":"Obama Goes for Accelerated Review of Healthcare Reform"},"content":{"rendered":"<p>The Obama administration has decided <a href=\"http:\/\/thecaucus.blogs.nytimes.com\/2011\/09\/29\/supreme-court-ruling-could-revive-health-care-for-2012-campaign\/\">not to appeal to the full 11<sup>th<\/sup> circuit court and go directly to the Supreme Court<\/a>, which means that we could see a ruling as early as June.<\/p>\n<p>I&#8217;m not sure what the tactics are here.<\/p>\n<p>There are three legal questions here<\/p>\n<ul>\n<li> The first question is whether they can rule on the mandate at all, since the anti-injunction act of 1869 prohibits suits against taxes until the tariff is actually levied.<\/li>\n<li> The second question is whether if part of the law is struck down, is the entire law struck down. (severability)<\/li>\n<li> The third question (and the biggie) is whether or not the mandate is constitutional.&nbsp;<\/li>\n<\/ul>\n<p>The third question is a slam dunk based on precedent, but I expect at least 4 of the justices to go full <i>Bush v. Gore<\/i> and find some contrived form of logic to ignore that.<\/p>\n<p>It pretty much comes down to Justice Kennedy, but <b>he<\/b> ruled for Bush in Bush v.
