{"id":187258,"date":"2013-04-29T19:21:00","date_gmt":"2013-04-30T00:21:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2013\/04\/29\/live-in-obedient-fear-citizen-56\/"},"modified":"2013-04-29T19:21:00","modified_gmt":"2013-04-30T00:21:00","slug":"live-in-obedient-fear-citizen-56","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2013\/04\/29\/live-in-obedient-fear-citizen-56\/","title":{"rendered":"Live in Obedient Fear, Citizen"},"content":{"rendered":"<p>It turns out that the interrogation of&nbsp; Dzhokhar Tsarnaev did not merely involve not notifying him of his Miranda rights.&nbsp; It may also have involved <a href=\"http:\/\/www.emptywheel.net\/2013\/04\/29\/tsarnaev-right-to-counsel-not-miranda-is-the-key\/\">ignoring specific requests for a lawyer<\/a>:<\/p>\n<blockquote><p><span style=\"color: blue;\">Since Dzhokhar Tsarnaev was taken into custody just over a week ago,  the hue and cry in the public and media discussion has centered on  \u201cMiranda\u201d rights and to what extent the \u201cpublic safety exception\u201d  thereto should come into play. That discussion has been almost uniformly  wrongheaded. I will return to this shortly, but for now wish to point  out something that appears to have mostly escaped notice of the media  and legal commentariat \u2013 Tsarnaev repeatedly tried to invoke his right  to counsel.<\/span><br \/><span style=\"color: blue;\"><br \/><\/span> <span style=\"color: blue;\">Tucked in the body of <a href=\"http:\/\/www.latimes.com\/news\/nationworld\/nation\/la-na-boston-bombing-20130426,0,5051005.story\">this Los Angeles Times report<\/a> is the startling revelation of Tsarnaev\u2019s attempt to invoke:<\/span><\/p>\n<blockquote><p><span style=\"color: blue;\">A senior congressional aide said Tsarnaev had asked  several times for a lawyer, but that request was ignored since he was  being questioned under the public safety exemption to the Miranda rule.  The exemption allows defendants to be questioned about imminent threats,  such as whether other plots are in the works or other plotters are on  the loose.<\/span><\/p><\/blockquote>\n<p><span style=\"color: blue;\">Assuming the accuracy of this report, the news of Tsarnaev repeatedly  attempting to invoke right to counsel is critically important because  now not only is the 5th Amendment right to silence in play, but so too  is the right to counsel under <i>both<\/i> the 5th and 6th Amendments.  While the two rights are commonly, and mistakenly, thought of as one in  the same due to the conflation in the language of the Miranda warnings,  they are actually somewhat distinct rights and principles. In fact,  there is no explicit right to counsel set out in the Fifth at all, it is  a creature of implication manufactured by the Supreme Court, while the  Sixth Amendment does have an explicit right to counsel, but it  putatively only attaches after charging, and is charge specific. Both  are critical to consideration of the Tsarnaev case; what follows is a  long, but necessary, discussion of why.<\/p>\n<p>\u2026\u2026\u2026<\/p>\n<p><\/span><span style=\"color: blue;\">The primacy, and fundamental nature of the right to custodial  interrogation counsel, however, was confirmed in the 1981 decision of <a href=\"http:\/\/supreme.justia.com\/cases\/federal\/us\/451\/477\/case.html\"><i>Edwards v. Arizona<\/i><\/a>,  where the court held suspects have the right under the Fifth and  Fourteenth Amendments to have counsel present during custodial  interrogation, as declared in Miranda, and that right cannot be invaded  absent a clear and valid waiver. While it is true, under <a href=\"http:\/\/www.law.cornell.edu\/supct\/html\/08-1470.ZS.html\"><i>Berghuis v.
