{"id":187989,"date":"2011-01-04T19:00:00","date_gmt":"2011-01-05T00:00:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2011\/01\/04\/when-does-antonin-scalia-start-to-wear-a-white-robe\/"},"modified":"2011-01-04T19:00:00","modified_gmt":"2011-01-05T00:00:00","slug":"when-does-antonin-scalia-start-to-wear-a-white-robe","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2011\/01\/04\/when-does-antonin-scalia-start-to-wear-a-white-robe\/","title":{"rendered":"When Does Antonin Scalia Start to Wear a White Robe?"},"content":{"rendered":"<p>He is now saying that absent legislation, <a href=\"http:\/\/www.huffingtonpost.com\/2011\/01\/03\/scalia-women-discrimination-constitution_n_803813.html\">there is a private right to discriminate against women<\/a>:<\/p>\n<blockquote style=\"color: blue;\"><p>The equal protection clause of the 14th Amendment to the U.S.  Constitution does not protect against discrimination on the basis of  gender or sexual orientation, according to Supreme Court Justice Antonin  Scalia.  <\/p>\n<p>In <a href=\"http:\/\/www.callawyer.com\/story.cfm?eid=913358&amp;evid=1\">a newly published interview<\/a> in the legal magazine <i>California Lawyer<\/i>,  Scalia said that while the Constitution does not disallow the passage  of legislation outlawing such discrimination, it doesn&#8217;t itself outlaw  that behavior:<\/p><\/blockquote>\n<p>Seriously, when then Assistant Attorney General wrote that William Renquist wrote that &#8220;A judge who is a &#8220;strict constructionist&#8221; in constitutional matters will generally <a href=\"http:\/\/www.slate.com\/id\/117140\/\">not be favorably inclined toward claims of either criminal defendants or civil rights plaintiffs<\/a>,&#8221; he wasn&#8217;t kidding.<\/p>\n<p>A strict constructionist is a judge who prejudges cases to benefit the powerful and corrupt.&nbsp; They are results based jurists, and the depressing thing is that Scalia is arguably only the 4<sup>th<\/sup> most insane member of the court right now, after Roberts, Alito, and Thomas.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>He is now saying that absent legislation, there is a private right to discriminate against women: The equal protection clause of the 14th Amendment to the U.S. Constitution does not protect against discrimination on the basis of gender or sexual orientation, according to Supreme Court Justice Antonin Scalia.
