{"id":189501,"date":"2010-03-19T19:38:00","date_gmt":"2010-03-20T00:38:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2010\/03\/19\/appeals-court-tells-fed-to-turn-over-records\/"},"modified":"2010-03-19T19:38:00","modified_gmt":"2010-03-20T00:38:00","slug":"appeals-court-tells-fed-to-turn-over-records","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2010\/03\/19\/appeals-court-tells-fed-to-turn-over-records\/","title":{"rendered":"Appeals Court Tells Fed to Turn Over Records"},"content":{"rendered":"<p>Well, the Federal Reserve just <a href=\"http:\/\/www.bloomberg.com\/apps\/news?pid=20601103&amp;sid=azmztIRQLqq8\">lost the next step of the court case<\/a>, with the U.S. Court of Appeals in Manhattan siding with the circuit court, and with plaintiff, <span>Bloomberg<\/span> News, that its records <span style=\"font-weight: bold;\">are<\/span> subject to the freedom of information act:<\/p>\n<blockquote><p><span style=\"color: rgb(0, 0, 153);\">The Fed had argued that disclosure of the documents threatens to stigmatize borrowers and cause them \u201csevere and irreparable competitive injury,\u201d discouraging banks in distress from seeking help. A three-judge panel of the appeals court rejected that argument in a unanimous decision.<\/span><\/p>\n<p><span style=\"color: rgb(0, 0, 153);\">The U.S. Freedom of Information Act, or <span>FOIA<\/span>, \u201csets forth no basis for the exemption the Board asks us to read into it,\u201d U.S. Circuit Chief Judge Dennis Jacobs wrote in the opinion. \u201cIf the Board believes such an exemption would better serve the national interest, it should ask Congress to amend the statute.\u201d<\/span><\/p>\n<p><span style=\"color: rgb(0, 0, 153);\">The opinion may not be the final word in the bid for the documents, which was launched by <span>Bloomberg<\/span> LP, the parent of <span>Bloomberg<\/span> News, with a November 2008 lawsuit. The Fed may seek a rehearing or appeal to the full appeals court and eventually petition the U.S. Supreme Court. <\/span><\/p><\/blockquote>\n<p>May?
