{"id":189634,"date":"2010-02-27T20:26:00","date_gmt":"2010-02-28T01:26:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2010\/02\/27\/this-is-a-case-to-watch\/"},"modified":"2010-02-27T20:26:00","modified_gmt":"2010-02-28T01:26:00","slug":"this-is-a-case-to-watch","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2010\/02\/27\/this-is-a-case-to-watch\/","title":{"rendered":"This is a Case to Watch"},"content":{"rendered":"<p>Sergey Aleynikov, a senior programmer for Goldman Sach&#8217;s high frequency trading software, <a href=\"http:\/\/www.nytimes.com\/2010\/02\/12\/technology\/12code.html\">has been indicted for software theft<\/a>.<\/p>\n<p>It&#8217;s alleged that he took the software, and sent copies of it to a server in Germany.<\/p>\n<p>This case is odd.<\/p>\n<p>First, the entire high frequency trading thing smells of corruption:  The idea is that by having servers colocated in the market, you pick up a few milliseconds speed, and so can execute trades between when someone else requests a buy, and when their transaction is actually executed.<\/p>\n<p>To my, admittedly untrained, gut this sounds <span style=\"font-weight: bold;\">identical<\/span> to front-running, which is illegal.<\/p>\n<p>Additionally, the twists and turns of the trial, where Aleynikov&#8217;s lawyers made some fairly routing requests for things like his personnel file to show that he was not a disgruntled employee, had the squid&#8217;s<sup>*<\/sup> lawyers <span style=\"font-weight: bold;\">seriously<\/span> freaking out, and suggesting that charges should be dropped.<\/p>\n<p>I think that there are some very real bits of corruption that might be uncovered in the trial, though the prosecution, defense, and judge might very well find a way to suppress that, because, after all, it&#8217;s Goldman Sachs, and rule number 1 of Goldman Sachs is that Goldman Sachs has friends in high places, so it <span style=\"font-weight: bold;\">always<\/span> gets what it wants.<\/p>\n<p>My prior posts are <a href=\"http:\/\/40yrs.blogspot.com\/search?q=Aleynikov\">here<\/a>.<\/p>\n<p><sup>*<\/sup><span style=\"font-size: 78%;\">Alas, I cannot claim credit for the bon mot describing Goldman Sachs as a, &#8220;great vampire squid wrapped around the face of humanity, relentlessly jamming its blood funnel into anything that smells like money.&#8221;  This was coined by the great Matt Taibbi, in his article on the <\/span><span style=\"font-size: 78%; text-decoration: line-through;\">massive criminal conspiracy<\/span><span style=\"font-size: 78%;\"> investment firm, <\/span><a href=\"http:\/\/www.rollingstone.com\/politics\/story\/28816321\/the_great_american_bubble_machine\"><span style=\"font-size: 78%; font-style: italic;\">The Great American Bubble Machine<\/span><\/a><span style=\"font-size: 78%;\">.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Sergey Aleynikov, a senior programmer for Goldman Sach&#8217;s high frequency trading software, has been indicted for software theft.
