{"id":190055,"date":"2010-01-12T14:54:00","date_gmt":"2010-01-12T19:54:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2010\/01\/12\/kansas-judge-declares-open-season-on-gynecologists\/"},"modified":"2010-01-12T14:54:00","modified_gmt":"2010-01-12T19:54:00","slug":"kansas-judge-declares-open-season-on-gynecologists","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2010\/01\/12\/kansas-judge-declares-open-season-on-gynecologists\/","title":{"rendered":"Kansas Judge Declares Open Season on Gynecologists"},"content":{"rendered":"<p>Sedgwick County Judge Warren Wilbert  has ruled that <a href=\"http:\/\/www.nytimes.com\/aponline\/2010\/01\/11\/us\/AP-US-Abortion-Shooting-Trial.html?partner=rss&amp;emc=rss&amp;pagewanted=all\">Scott Roeder may present to the jury a defense that his actions were &#8220;justifiable homicide&#8221;<\/a>, which carries a 5 year sentence:<\/p>\n<blockquote style=\"color: rgb(0, 0, 153);\"><p>&#8221;This judge has basically announced a <span style=\"font-weight: bold;\">death sentence for all of us who help women<\/span>,&#8221; said Dr. Warren Hern of Boulder, Colo., a longtime friend of Tiller who also performs late-term abortions. &#8221;That is the effect of the ruling.&#8221;<\/p><\/blockquote>\n<p>Dr. Hern is 100% correct<\/p>\n<blockquote style=\"color: rgb(0, 0, 153);\"><p>The facts of the case are not in dispute: On a balmy Sunday morning, Roeder got up from a pew at Wichita&#8217;s Reformation Lutheran Church at the start of services and walked to the foyer, where Tiller and a fellow usher were chatting around a table. Wordlessly, he pressed the barrel of a .22-caliber handgun to Tiller&#8217;s forehead and pulled the trigger.<\/p>\n<p>Prosecutors charged Roeder with first-degree murder, and the 51-year-old from Kansas City, Mo., later admitted to reporters and in a court filing that he killed Tiller.
