{"id":190605,"date":"2009-11-10T11:41:00","date_gmt":"2009-11-10T16:41:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2009\/11\/10\/someone-needs-a-serious-chill-pill\/"},"modified":"2009-11-10T11:41:00","modified_gmt":"2009-11-10T16:41:00","slug":"someone-needs-a-serious-chill-pill","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2009\/11\/10\/someone-needs-a-serious-chill-pill\/","title":{"rendered":"Someone Needs a Serious Chill Pill"},"content":{"rendered":"<div style=\"border: 1px solid black; margin: 0px 10px; width: 220px; float: right; text-align: center;\"><a href=\"http:\/\/img36.imageshack.us\/img36\/2316\/porschecrocs038510311.jpg\"><img decoding=\"async\" src=\"http:\/\/img36.imageshack.us\/img36\/2316\/porschecrocs038510311.jpg\" bordercolor=\"white\" border=\"0\" \/><\/a> <span style=\"font-style: italic;\"><span style=\"font-weight: bold;\">That<\/span> explains, why my sandals go from 0-60 in 5.2 Seconds<br \/><\/span><\/div>\n<p>Porsche makes a $50,000+ sports car it calls the Cayman.<\/p>\n<p>Crocs, the makers of the ugly sandals, makes a pair of ugly sandals called the Cayman.<\/p>\n<p>For what it&#8217;s worth, <a href=\"http:\/\/money.cnn.com\/2009\/11\/10\/autos\/porsche_vs_crocs\/index.htm\">Porsche has sued Crocs the name<\/a>, claiming violation of trademark.<\/p>\n<p>Honestly, I think that Crocs have a better claim to the name, given that the Caymans (the reptile is a c<span style=\"font-weight: bold;\">ai<\/span>man) are an island where one walks on the beach, but that&#8217;s irrelevant.<\/p>\n<p>The real question is whether there is any possibility of confusion between a 2,954 lb sports car, and a 5 oz shoe.<\/p>\n<p>The purpose of a trademark is not to give a company exclusive use of a name, but to <span style=\"font-weight: bold;\">avoid consumer confusion<\/span>, and as best as I can tell the shoes predate the car anyway (see <a href=\"http:\/\/www.footnoted.org\/buried-treasure\/porsche-vs-crocs\/\">comments here<\/a>), which would strongly imply that Crocs has the advantage such as it is.<\/p>\n<p>In any case, Porsche got an injunction against the shoes in Germany, but Germany has weird IP law.<sup>*<\/sup><\/p>\n<p><sup>*<\/sup><span style=\"font-size:78%;\">This is what got us that Mercedes ad where they say that they have a patent on crumple zones, but &#8220;Never enforced the Patent&#8221;.  They never enforced the patent, because it is not recognized anywhere else in the world.<\/span><sup>\u2020<\/sup><\/p>\n<p><sup>\u2020<\/sup><span style=\"font-size:78%;\">I believe Germany changed their patent laws at some point in the 1970s.<\/span><sup>\u2021<\/sup><\/p>\n<p><sup>\u2021<\/sup><span style=\"font-size:78%;\">I offer the caveat that these comments in the footnotes regarding the Mercedes patent are recollections of a conversation over a decade ago vague 20+ year old memories though, so YMMV, though <a href=\"http:\/\/lmgtfy.com\/?q=crumple+zones+%22never+enforced+the+patent%22\">a Google search<\/a> does have people who recall the ad.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>That explains, why my sandals go from 0-60 in 5.2 Seconds Porsche makes a $50,000+ sports car it calls the Cayman.
