{"id":191250,"date":"2009-09-09T15:45:00","date_gmt":"2009-09-09T20:45:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2009\/09\/09\/the-end-of-the-ratings-agency\/"},"modified":"2009-09-09T15:45:00","modified_gmt":"2009-09-09T20:45:00","slug":"the-end-of-the-ratings-agency","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2009\/09\/09\/the-end-of-the-ratings-agency\/","title":{"rendered":"The End of the Ratings Agency?"},"content":{"rendered":"<p>We are seeing two things going on here.<\/p>\n<p>First, we have a crisis in confidence in the ratings agencies, best exemplified by the decision of <a href=\"http:\/\/www.bloomberg.com\/apps\/news?pid=20601110&amp;sid=aebfBaxxY1aE\">state insurance regulators reviewing their reliance on ratings agencies<\/a>:<\/p>\n<blockquote><p>State regulators scheduled a hearing to review their reliance on ratings firms in grading insurers\u2019 financial strength and whether changes are needed after the plunge of top-ranked bonds exposed flaws in credit scores.<\/p><\/blockquote>\n<p>If people no longer believe in ratings agencies, then they no longer have a business.<\/p>\n<p>They business is quite literally a confidence game.<\/p>\n<p>This, however is a long term problem.<\/p>\n<p>The more immediate problem is that the Courts have finally got a clue, and determined that in the presence of evidence, email messages specifically, that these agencies were &#8220;putting lipstick on a pig,&#8221; that the <a href=\"http:\/\/www.cnbc.com\/\/id\/32732991\">ratings agencies can be held liable for fraud<\/a>, and that these opinions, which they sell not subject to 1<sup>st<\/sup> amendment protections.<\/p>\n<p>There are clear indications, emails and the like, that the ratings agencies were deliberately issuing inaccurate ratings in order to boost market share and consulting income.<\/p>\n<p>David Einhorn explains why the recent suit against the ratings agencies is so catastrophic:<\/p>\n<p><embed name=\"cnbcplayer\" pluginspage=\"http:\/\/www.macromedia.com\/go\/getflashplayer\" allowfullscreen=\"true\" allowscriptaccess=\"always\" bgcolor=\"#000000\" quality=\"best\" wmode=\"transparent\" scale=\"noscale\" salign=\"lt\" src=\"http:\/\/plus.cnbc.com\/rssvideosearch\/action\/player\/id\/1245722885\/code\/cnbcplayershare\" type=\"application\/x-shockwave-flash\" height=\"380\" width=\"400\"><\/embed><\/p>\n<p>Their ratings business is <span style=\"font-weight: bold;\">entirely<\/span> dependent on a lack of legal jeopardy, and they have now lost this.<\/p>\n<p>Doubtless there will be some sort of ratings business, but I expect it to be <span style=\"font-weight: bold;\">very<\/span> tightly regulated, or possibly done by a federal agency.<\/p>\n<p>And then there is <a href=\"http:\/\/www.cnbc.com\/\/id\/32734618\">this bit of Panglossian crap<\/a>:<\/p>\n<p><embed name=\"cnbcplayer\" pluginspage=\"http:\/\/www.macromedia.com\/go\/getflashplayer\" allowfullscreen=\"true\" allowscriptaccess=\"always\" bgcolor=\"#000000\" quality=\"best\" wmode=\"transparent\" scale=\"noscale\" salign=\"lt\" src=\"http:\/\/plus.cnbc.com\/rssvideosearch\/action\/player\/id\/1245699019\/code\/cnbcplayershare\" type=\"application\/x-shockwave-flash\" height=\"380\" width=\"400\"><\/embed><\/p>\n<p>Note the comment at about 6:10, <\/p>\n<blockquote style=\"color: rgb(0, 0, 153);\"><p>There has already been a shift.  There&#8217;s a recognition; there&#8217;s potential liability, and any intelligent compliance officer at the investment bank, at the major money managers, are going to say, &#8220;We have to do something about this,&#8221; and they are in the process of changing their practices.<\/p><\/blockquote>\n<p>I would not trust this guy to manage a lemonade stand.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>We are seeing two things going on here.
