I think that the individual mandate is flawed, but it is the <span style=\"font-weight:bold;\">only<\/span> thing that states are allowed to do under ERISA, so that is everyone&#8217;s solution.<\/p>\n<p>Just eliminating the preemption clause from ERISA would go a long way toward solving the problem, because states would compete on the quality and cost effectiveness of their health care for businesses, as opposed to competing on tax giveaways.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>They are looking to move from a fee for service to a flat fee per patient.
