{"id":192019,"date":"2009-05-21T23:08:00","date_gmt":"2009-05-22T04:08:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2009\/05\/21\/morons-trying-to-drum-up-billable-hours\/"},"modified":"2009-05-21T23:08:00","modified_gmt":"2009-05-22T04:08:00","slug":"morons-trying-to-drum-up-billable-hours","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2009\/05\/21\/morons-trying-to-drum-up-billable-hours\/","title":{"rendered":"Morons Trying to Drum Up Billable HOurs"},"content":{"rendered":"<p>So, two lawyers specializing in IP litigation <a href=\"http:\/\/www.washingtonpost.com\/wp-dyn\/content\/article\/2009\/05\/15\/AR2009051503000.html\">have proposed changes in copyright and anti-trust law to bolster newspapers<\/a>.<\/p>\n<p>Unsurprisingly, their proposals would create an explosion of litigation, which would mean that they could buy that yacht that they have their eye on.<\/p>\n<p>What they propose:<\/p>\n<ul>\n<li>Ummm&#8230;.Making search engines indexing web sites a copyright violation?<\/li>\n<ul>\n<li> The idea here is that creating an index is a copyright violation, which means that things like the old index of periodicals in the library, an essential research tool, would be illegal.<\/li>\n<\/ul>\n<li>And allow newspapers to price fix, so that they can <span style=\"font-weight: bold;\">all<\/span> start charging for online content.<\/li>\n<ul>\n<li>Let&#8217;s note that newspapers are not in the business of selling the content called &#8220;news&#8221;, they are in the business of selling advertising.  The cost of purchasing a paper only covers the cost of the ink, paper, and printing.  That&#8217;s why, when the chains started buying up newspapers, and cutting newsrooms about 2 decades ago, they could generate those 20%+ margins on a much crappier product.<\/li>\n<li>The threat to newspapers is not people reading their news online, <span style=\"font-weight: bold;\">it&#8217;s Craig&#8217;s List<\/span>. It&#8217;s the loss of classified ad revenue that has put these institutions behind the financial 8-ball<\/li>\n<ul>\n<li> Oh, yes, there&#8217;s also the issue of <span style=\"font-weight: bold;\">accumulating insane levels of debt<\/span> to build these chains in the first place.<\/li>\n<\/ul>\n<\/ul>\n<li>Federalizing the &#8220;hot news&#8221; doctrine.<\/li>\n<ul>\n<li>This one is just plain stupid.  It&#8217;s a 1918 decision which says that a news service cannot take a story from another, rewrite it, and pass it off as it&#8217;s own, which is a good idea, but they want to make the <span style=\"font-weight: bold;\">reporting that a news source broke a story<\/span>, like, &#8220;The <span style=\"font-style: italic;\">Wall Street Journal<\/span> reported today that sources in the Treasury have determined<\/li>\n<\/ul>\n<\/ul>\n<p>As <a href=\"http:\/\/www.huffingtonpost.com\/timothy-karr\/big-media-myopia_b_204330.html\">Timothy Karr notes<\/a><\/p>\n<blockquote style=\"color: rgb(0, 0, 153);\"><p>But consider this. Just a few years ago, the average profit margin for newspapers was 20 percent &#8212; with some raking in twice as much or more.<\/p>\n<p>&#8220;Did they use these astronomical profits to invest in the quality of their products or to innovate for the future?&#8221; asked Free Press&#8217; Craig Aaron on Thursday. <span style=\"font-weight: bold;\">&#8220;No. They just bought up more newspapers and TV stations.<\/span>&#8221; (On May 12 Free Press released a National Journalism Strategy that outlines forward-thinking policies to save journalism, and not merely prop up the creaking old guard.)<\/p><\/blockquote>\n<p>(<span style=\"font-style: italic;\">emphasis mine<\/span>)<\/p>\n<p>I am not concerned about the future of <span style=\"font-weight: bold;\">news papers<\/span>, I am concerned about the future of <span style=\"font-weight: bold;\">journalism<\/span>&#8230;&#8230;Scratch that&#8230;I am concerned about the <span style=\"font-weight: bold;\">present<\/span> of journalism, because the professionals out there, whether covering George W. Bush, the housing bubble, or just <span style=\"font-weight: bold;\">publishing this bit of crap<\/span>, seems to be in a state of incompetent free fall.<\/p>\n<p>Professional journalism today in the United States is a captive of those that they cover, and so people like me go to foreign and not-for-profit sources to find our news.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>So, two lawyers specializing in IP litigation have proposed changes in copyright and anti-trust law to bolster newspapers.
