{"id":194513,"date":"2008-09-16T23:33:00","date_gmt":"2008-09-17T04:33:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2008\/09\/16\/breathalyzer-firm-must-turn-over-source-code\/"},"modified":"2008-09-16T23:33:00","modified_gmt":"2008-09-17T04:33:00","slug":"breathalyzer-firm-must-turn-over-source-code","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2008\/09\/16\/breathalyzer-firm-must-turn-over-source-code\/","title":{"rendered":"Breathalyzer Firm Must Turn Over Source Code"},"content":{"rendered":"<p>In Arizona, Pima County Superior Court Judge Deborah Bernin has told breathalyzer manufacturer CMI to <a href=\"http:\/\/www.theregister.co.uk\/2008\/09\/15\/dui_kit_reliability_legal_spat\/\">turn over the source code for their devices to the defendants<\/a>.<\/p>\n<p>This is more than just a legal ploy to get out of a drunk driving charge,<sup>*<\/sup> there actually appear to be some reliability issues with the device in question:<\/p>\n<blockquote style=\"color: rgb(0, 0, 153);\"><p>Allegedly inconsistent, odd or inexplicable results involving the Intoxilyzer 8000 have led to legal action in six states (Florida, Louisiana, Massachusetts, Minnesota, Tennessee and New Jersey as well as Arizona). A Florida judge also ordered CMI to hand over the source code running the controversial devices but the firm has refused to comply, earning it $1.2m in fines as a result.<\/p><\/blockquote>\n<p>I support this ruling, even <span style=\"font-weight: bold;\">without<\/span> the history of problems.
