{"id":194735,"date":"2008-08-22T17:38:00","date_gmt":"2008-08-22T22:38:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2008\/08\/22\/federal-judge-rips-the-texas-courts-a-new-one-on-capital-case\/"},"modified":"2008-08-22T17:38:00","modified_gmt":"2008-08-22T22:38:00","slug":"federal-judge-rips-the-texas-courts-a-new-one-on-capital-case","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2008\/08\/22\/federal-judge-rips-the-texas-courts-a-new-one-on-capital-case\/","title":{"rendered":"Federal Judge Rips the Texas Courts a New One on Capital Case"},"content":{"rendered":"<p>It appears that Federal Judge Orlando Garcia is <a href=\"http:\/\/www.nytimes.com\/2008\/08\/22\/us\/22texas.html?bl&amp;ex=1219550400&amp;en=f3382fa42a9af6ce&amp;ei=5087%0A\">upset at the state of the death penalty in Texas<\/a>, and said so in his ruling granting a stay for Jeffery Lee Wood.<\/p>\n<p>The judge described the positively Kafkaesque system under which he was determined to be competent for execution, as, &#8220;an insane system,&#8221; because it required that he prove that he was insane before the state would grant him a lawyer and a psychologist to prove that he was insane.<\/p>\n<p>In addition to his not pulling the trigger, he was driving the getaway car, the man has a long history of mental problems and retardation.<\/p>\n<p>I understand why the Judge finds this insane, but he does not understand Texas.
