{"id":195171,"date":"2008-07-25T15:52:00","date_gmt":"2008-07-25T20:52:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2008\/07\/25\/more-bad-ip-legislation\/"},"modified":"2008-07-25T15:52:00","modified_gmt":"2008-07-25T20:52:00","slug":"more-bad-ip-legislation","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2008\/07\/25\/more-bad-ip-legislation\/","title":{"rendered":"More Bad IP Legislation"},"content":{"rendered":"<p>Well, it appears that Senator Patrick Leahy has <a href=\"http:\/\/arstechnica.com\/news.ars\/post\/20080725-senator-fuses-controversial-ip-bills-into-big-bad-package.html\">merged two draconian IP bills to create a bill that combines the worst of both<\/a>.<\/p>\n<p>I think that the problem is two fold:<\/p>\n<ul>\n<li>The large IP driven businesses know that their business model exists only because of government support, so they spend lavishly.<\/li>\n<li>That IP enforcement has been defined as ownership, when it is merely an exclusive license granted for the benefit of society.<\/li>\n<\/ul>\n<p>So, we now have<\/p>\n<ul>\n<li>Doubling of penalties<\/li>\n<li>The authorization of federal prosecutors to use <span style=\"font-weight: bold;\">civil<\/span> suits, where the burden of evidence is 50%+1<\/li>\n<li>Confiscation of any property tangentially involved, like computers and <span style=\"font-weight: bold;\">houses<\/span>.<\/li>\n<li>The creation of an IP &#8220;Czar&#8221;, which would necessarily lead to an expansive and aggressive policy towards pursuing the law, as it is how the &#8220;Czar&#8217;s&#8221; office would justify its existence.<\/li>\n<\/ul>\n<p>Bad law, bad policy, and a fundamental misunderstanding of the reasons behind copyright and patent protections.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Well, it appears that Senator Patrick Leahy has merged two draconian IP bills to create a bill that combines the worst of both.
