The unclassified portions of decision by the the U.S. Court of Appeals for the District of Columbia regarding Uighur’s imprisoned at Gitmo has now been released<\/a>. (Background here<\/a>)<\/p>\n

With some derision for the Bush administration\u2019s arguments, a three-judge panel said the government contended that its accusations against the detainee should be accepted as true because they had been repeated in at least three secret documents.<\/p>\n

The court compared that to the absurd declaration of a character in the Lewis Carroll<\/strong> poem \u201cThe Hunting of the Snark\u201d: \u201cI have said it thrice: What I tell you three times is true.\u201d<\/p>\n

\u201cThis comes perilously close to suggesting that whatever the government says must be treated as true,\u201d said the panel of the Court of Appeals for the District of Columbia Circuit.<\/p>\n

The unanimous panel overturned as invalid a Pentagon determination that the detainee, Huzaifa Parhat, a member of the ethnic Uighur Muslim minority in western China, was properly held as an enemy combatant.<\/p>\n

The panel included one of the court\u2019s most conservative members, the chief judge, David B. Sentelle.<\/p>\n

Pentagon officials have claimed that the Uighurs at Guant\u00e1namo were \u201caffiliated\u201d with a Uighur resistance group, the East Turkestan Islamic Movement, and that it, in turn, was \u201cassociated\u201d with Al Qaeda and the Taliban.<\/span><\/p>\n

The court said the classified evidence supporting the Pentagon\u2019s claims included assertions that events had \u201creportedly\u201d occurred and that the connections were \u201csaid to\u201d exist, without providing information about the source of such information.<\/span><\/strong><\/p><\/blockquote>\n
