{"id":196574,"date":"2008-04-13T19:14:00","date_gmt":"2008-04-14T00:14:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2008\/04\/13\/bullsh-john-yoo-torturer-edition\/"},"modified":"2008-04-13T19:14:00","modified_gmt":"2008-04-14T00:14:00","slug":"bullsh-john-yoo-torturer-edition","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2008\/04\/13\/bullsh-john-yoo-torturer-edition\/","title":{"rendered":"Bullsh@$!!!!, John Yoo, Torturer Edition"},"content":{"rendered":"<p>The <a href=\"http:\/\/thinkprogress.org\/2008\/04\/09\/nationals-lawyers-guild-calls-for-yoos-disbarment\/\">National Lawyers Guild is calling for Yoo\u2019s firing by UC Berkeley and his disbarment<\/a>.<\/p>\n<p>Additionally, they call for him to be tried as a war criminal.<\/p>\n<p>Christopher Edley, Jr., the Dean of the UC Law School, is saying that <a href=\"http:\/\/www.law.berkeley.edu\/news\/2008\/edley041008.html\">while he disagrees with Yoo&#8217;s positions, it would be an infringement on academic freedom to take action against him<\/a>.<\/p>\n<p>Christopher Edley, Jr. is an embarrassment to the profession of law, and to the entire academic world for taking this position, though I don&#8217;t think that Edley should be fired for this.<\/p>\n<p>The difference between espousing torture and engaging in a criminal conspiracy to promulgate actual torture.<\/p>\n<p>There is a difference between a lawyer who defends a mobster, and a Consigliere, who actively aids and abets law breaking.  Mr. Yoo was clearly the latter.<\/p>\n<p>I would also note that in some of the lesser known Nuremberg trials, judges and lawyers were <a href=\"http:\/\/en.wikipedia.org\/wiki\/Judges%27_Trial\">tried and convicted for their roles<\/a> which consisted of supplying legal advice and justifications, just like Yoo:<br \/><span style=\"color: rgb(0, 0, 153);\"><\/span><\/p>\n<blockquote><p><span style=\"font-size:130%;\"><span style=\"color: rgb(0, 0, 153);\"><span style=\"font-weight: bold;\">Indictment<\/span> <\/span><\/span><\/p>\n<ol style=\"color: rgb(0, 0, 153);\">\n<li>Participating in a common plan or conspiracy to commit <a href=\"http:\/\/en.wikipedia.org\/wiki\/War_crime\" title=\"War crime\">war crimes<\/a> and <a href=\"http:\/\/en.wikipedia.org\/wiki\/Crime_against_humanity\" title=\"Crime against humanity\">crimes against humanity<\/a>;<\/li>\n<li>War crimes through the abuse of the judicial and penal process, resulting in mass murder, torture, plunder of private property.<\/li>\n<li>Crimes against humanity on the same grounds, including <a href=\"http:\/\/en.wikipedia.org\/wiki\/Slave_labor\" title=\"Slave labor\">slave labor<\/a> charges.<\/li>\n<\/ol>\n<\/blockquote>\n<p>I would suggest that anyone on the UC fund raising or alumni list seriously consider their responses in the future.<\/p>\n<p>Check out my <a href=\"http:\/\/40yrs.blogspot.com\/2008\/04\/damn-good-writing-gen-jc-christian.html\">earlier post on this matter<\/a> merely referred to one of the General&#8217;s magnificent snarks, so you might want to look elsewhere for greater analysis.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The National Lawyers Guild is calling for Yoo\u2019s firing by UC Berkeley and his disbarment.
