{"id":199215,"date":"2007-08-24T05:37:00","date_gmt":"2007-08-24T10:37:00","guid":{"rendered":"https:\/\/www.panix.com\/~msaroff\/40years\/2007\/08\/24\/abusive-patent-practices\/"},"modified":"2007-08-24T05:37:00","modified_gmt":"2007-08-24T10:37:00","slug":"abusive-patent-practices","status":"publish","type":"post","link":"https:\/\/www.panix.com\/~msaroff\/40years\/2007\/08\/24\/abusive-patent-practices\/","title":{"rendered":"Abusive Patent Practices"},"content":{"rendered":"<p>Well, it looks like everyone&#8217;s favorite patent troll, Rambus <a href=\"http:\/\/www.theregister.co.uk\/2007\/08\/23\/rambus_ec_objections_patents_dram\/\">is about to get spanked by the EU<\/a>.<\/p>\n<blockquote style=\"color: rgb(0, 0, 153);\"><p>The European Commission has confirmed formal &#8220;patent ambush&#8221; charges against US memory chip designer Rambus.<\/p>\n<p>&#8230;..<\/p>\n<p>It said that &#8220;Rambus engaged in intentional deceptive conduct in the context of the standard-setting process, for example by not disclosing the existence of the patents which it later claimed were relevant to the adopted standard.&#8221;<\/p>\n<p>&#8230;..<\/p>\n<p>The FTC found that Rambus had through subterfuge, illegally gained a monopoly in four key memory technologies.<\/p><\/blockquote>\n<p>The gist of all this is that Rambus had an idea, a patentable idea, about how to improve memory performance.<\/p>\n<p>It wasn&#8217;t a bad idea, but it wasn&#8217;t better than any of the other ideas out there either.<\/p>\n<p>However, when the JEDEC was drawing up standards for the next generation of memory, Rambus, which participated in this board, <span style=\"font-weight: bold;\">deliberately<\/span>, and <span style=\"font-weight: bold;\">deceptively<\/span> kept the information that they had this IP, and that people who signed off on this standard would have to pay them royalties in order to use it.<\/p>\n<p>Had Rambus revealed the status of their IP during the development of this standard, <span style=\"font-weight: bold;\">as required by law<\/span>, the standard would have been drawn up in a way so as not to require their technology.<\/p>\n<p>Personally, I think that people should go <span style=\"font-weight: bold;\">RICO<\/span> on their butts, definately to the extent of putting them out of business, and hopefully to the extent of bankrupting principals in this scheme and sending them to jail.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Well, it looks like everyone&#8217;s favorite patent troll, Rambus is about to get spanked by the EU.
